    Classification of trademark registration in Vietnam of generator products

    Group 7

    Machines and machine tools; machines and engines (excluding engines used for land vehicles); transmission linkages and belts (not for land vehicles); generators, generators driven by engines; compressors, motor-driven compressors; high-pressure pump driven by machine or motor; electric welding machine, motor-driven electric welding machine, motor-driven electric arc welding machine.

    Group 9

    Electric welding equipment, motor-driven electric welding equipment, electric arc welding equipment, motor-driven arc welding equipment

    Some reputable generator trademarks in the market

    Kubota generator

    The smallest power generator mark among Japanese generator trademarks. Kubota generators only have a capacity of 7.5 – 40kVA. Goods suitable for the needs of households or individuals with small and medium businesses.

    Mitsubishi generator

    A famous Japanese generator manufacturer. The capacity range of the serving machine is from 10kVA – 2000kVA. Mitsubishi is known for its good quality. These generators can run 24 x 7 and go with various features like larger fuel tanks and automatic voltage control. Mid-range Mitsubishi generator price should be the choice of many users.

    Denyo generator

    Denyo is one of the famous Japanese generator manufacturers for its excellent noise resistance. Like other Japanese generator marks, Denyo is also a generator assembling company. The company uses generators of engine trademarks such as Isuzu, Kubota, Yanmar, etc. The biggest drawback of this Denyo generator product is the high price.

    Perkins generator

    Among the well-known generator manufacturers, Perkins is a durable diesel engine that can be backed up for a long time. From small engines to large engines, Perkins achieves high performance with low fuel consumption. Perkins serves its customers from 9.1kVA – 2250kVA capacity. However, because it is a British mark of generators, the price of Perkins is very high. Perkins is suitable for use in remote areas, islands where there is no electricity grid and the need to use generators is frequent.

    Kofo generator

    Kofo is a famous generator manufacturer from China, Kofo is currently very interested in Vietnam. Kofo generators mainly focus on serving customers in the capacity range from 15kVA – 300kVA. Kofo mainly targets the mid-range customer segment. Kofo’s generator price is much cheaper than other famous brands.

    Cummins generator

    Cummins is a world leader in the design and manufacture of generator engines and equipment. The company provides its generator sets with a capacity of 15kVA – 3000kVA. However, the company is providing generators from 15kVA – 500kVA. The range of 250kVA to 500kVA is used during construction to supply power to offices, cranes, and construction sites. Generators from 500kVA – 3000kVA are used for fixed installation as a backup power source for most buildings.

    Procedure to trademark registration in Vietnam of generator products

    Step 1: Select a mark, goods and services  for the trademark

    The first step we need to trademark registration in Vietnam of generator products is select a suitable and impressive mark.

    • Trademark selection: Select a trademark template that meets the protection criteria. The selected mark is not similar to other registered trademarks, well-known trademarks.
    • Select the list of registered products: You need to select the list of goods and services bearing the trademark according to the above instructions. Grouping of goods and services to be carried out according to the latest updated versions of the Nice International Classification of Trademarks.

    Step 2: Research trademarks

    To perform a trademark search, customers only need to provide Viet An Law:

    • Trademark template;
    • List of products and services to research and register.

    Step 3: Submit registration form

    • After an in-depth search and the mark is judged to be registrable, the applicant will proceed to submit a registration application.
    • Agencies receiving and processing dossiers and collecting registration fees in Vietnam: National Office of Intellectual Property..

    Step 4: Formality examination of the application

    • The time limit for formal examination of a trademark application is 1 month from the filing date.
    • The NOIP will consider the application for eligibility in terms of form, label form, application owner, filing right, subheading, etc.
    • If the enterprise’s application meets the conditions. The NOIP will issue a Notice of acceptance of a valid application and publish the application.
    • If the enterprise’s application does not meet the conditions. The NOIP will issue a Notice of Non-acceptance of the application and request the enterprise to amend it. The application owner and the applicant’s representative shall make amendments as required. Then, proceed to submit the revised official letter to the NOIP and pay an additional fee if the group is classified incorrectly.

    Step 5: Publication of trademark application

    • Time limit for publication of trademark application: 02 months from the date of notification of valid application acceptance.
    • Contents of application announcement include: Information about valid applications stated in the notice of acceptance of valid applications, trademark samples and a list of goods and services.

    Step 6: Substantive examination of the application

    Time limit for substantive examination: 09 months from the date of application publication.

    Step 7: Pay the fee for granting a trademark protection title

    The final step to trademark registration in Vietnam of generator products is after receiving the notice of intention to grant a protection title, the applicant shall pay the granting fee.
