Trademark registration classification:

Trademarked products are required by law to be classified according to the Nice Classification. From there, it can be seen that tutor services belong to Class 41.

A trademark registration dossier includes:

• 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
• A list of goods/services intended to register;
• A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
• A power of attorney;
• Receipts of fee payment.

Time to carry out trademark registration:

• Form appraisal: 01 months from the date of submitting;
• Publish the trademark registration: 02 months from the date of receiving notice to accept as a valid application;
• Content appraisal: 09 – 12 months from the date of submitting;
• Grant the protection title: 02 – 03 months from the date of paying a registration fee.

Notices: Trademarks are only protected if these following conditions are met:\

• Is a visible sign in the form of letters, words, drawings, pictures, including holograms or a combination of those elements, expressed in one or more colors;
• Being able to distinguish the goods or services of the mark owner from those of other subjects.

Therefore, customers should note that the design of a trademark must not be identical or confusingly similar to a protected trademark or trade name of another subject.
