Garbage Treatment Services Trademarks Registration in Vietnam

Garbage Treatment Services Trademarks Registration in Vietnam

Because, in addition to black-and-white, the trademark owner can use other colors but still be protected. In case of registration for color trademark protection, customers are only allowed to use colors as registered during the business process.

  • Carry out trademark search and give advice, assess the possibility of trademark registration:

The search helps to assess the possibility of trademark registration, whether it is identical or confusingly similar to another protected trademark or not. The search services of Viet An Law consist of 2 phases: preliminary search and search at the Intellectual Property office. 

  • Advice on a plan to modify the trademark intended to be registered:

After having the search result, in case there are identical or confusing similar to another protected trademark, Viet An Law will offer an amendment plan for customers. If the possibility of trademark registration is strong, Viet An Law will accelerate the registration process to save time and ensure benefits for businesses.

  • Draft dossier and submit at the Intellectual Property office:

A garbage treatment services trademark registration dossier includes:

– A trademark registration declaration;

– A trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;

– A valid copy of personal identification if the owner is an individual; business registration certificate or investment certificate if the owner is an organization;

– A list of goods/services (classified under class 40 according to the Nice Classification);

– A power of attorney;

– Receipts of fee payment.

The dossier will be submitted at the Intellectual Property office and it takes about 13 – 18 months to consider the application and grant the protection title.

– Monitor the registration process at the Intellectual Property office;

– Represent for customers in the process and discuss with the Intellectual Property office;

– Discuss, provide information to customers in the registration process;

Term of trademark protection and extension of protection:

According to Law on Intellectual Property office, a trademark registration certificate is valid from the date of issue to the end of 10 years from the date of applying. Trademarks may not be used by the owner or by the person authorized by the owner for 5 consecutive years before the date of the request for termination without acceptable reasons (unless the use is restarted at least 3 months before the date of the request for termination of validity), the protection title shall be terminated.

Besides, the protection title can be renewed many consecutive times for 10 years each and must meet the following conditions:

  • Within 06 months before the expiry date of the protection title, the owner of the certificate shall submit a request for an extension to the Intellectual Property office (can be submitted later than the time limit specified above, but not later than 06 months from the date the protection title expires);
  • Pay the renewal fee.
