Alcohol Products Trademarks Registration in Vietnam

Alcohol is an alcoholic beverage, beneficial for the digestive tract, heart and helps calm when consumed in moderation and properly. On the Vietnamese market, there are a lot of fake alcohol products, alcohol diluted from alcohol are traded and consumed. Therefore, consumers are very concerned with quality, origin and origin of alcohols. Currently, the fact that alcohol businesses want to attract customers is also a bit of a problem. One of the solutions that manufacturers can use is trademark registration for alcohol products. On the one hand, it helps increase customers’ trust when choosing to buy, on the other hand, it helps them not to counterfeit their alcohol products. 

Alcohol Products Trademarks Registration in Vietnam

Regarding trademark registration, customers can refer to the following procedures:

  • 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of goods/services intended to register (Alcohol products, under class 33 by the Nice Classification of goods and services);
  • A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney;
  • Receipts of fee payment.

For collective trademarks/certification trademarks, the following documents are required:

  • Regulations on the use of the collective trademarks/certification trademarks;
  • A description of the characteristic (or specific) nature and quality of the product bearing trademark (if the trademark is registered as a collective trademark for a particular product or a certification trademark quantity of the product or trademark certifying of geographical origin);
  • A geographic area map (if the registered trademark is a trademark certifying the geographical origin of the product, or a collective trademark, the certification trademark contains a place name or other trademarks indicating the geographical origin of the local property product);
  • A document of the People’s Committee of the province or centrally run city permitting the registration of the trademark (if the registered trademark is a collective trademark, the certification trademark contains place names or other trademarks indicating the geographical origin of the local property product).

Submit application and process application results:

This process includes the following steps: Form appraisal; Publish the application on the gazette; Content appraisal; Grant and Publish the protection title. Note: Before the Intellectual Property office issues a refusal notice to accept a valid application, notice of refusal to grant a protection title or decision to grant a protection title, the applicant can take the initiative or on request of the Intellectual Property office amending and supplementing application documents. However, the amendment and supplementation of an application must not extend the scope of protection beyond the contents of the list of goods and services for the trademark registration application and must not change the nature of the object stated in the application.
