Based on the Nice Classification of goods and services, based on the materials creating the cup and mug products, trademark registration for cup and mug products can be done for the following classes of goods and services:

Class 16: Cups and mugs made of paper;
Class 21: Cups and mugs made of plastic, glass, ceramic, earthenware, porcelain, terracotta…;
Class 35: Buying, selling, import-export, displaying, and introducing cup and mug products.

In case of registering a collective mark or certification mark, provide the following additional documents:

The trademark registration declaration is made according to Form No. 08 Appendix 1 issued with Decree No. 65/2023/ND-CP.
Register directly / via post at the Head Office or Representative Office of the Intellectual Property Office of Vietnam (IP Vietnam) in Hanoi or Representative Offices of IP Vietnam in Ho Chi Minh City and Da Nang.

Sequence and procedures for trademark registration for cup and mug products
Step 1: Search for trademark protection capability for cup and mug products through the following methods:
Paid search from the Intellectual Property Office.
Step 2: Submit trademark registration dossier for cup and mug products to the Intellectual Property Office and pay trademark registration fees and charges
Step 3: The Intellectual Property Office reviews the validity of the application in terms of form and notifies the results of the formal examination of the application within 01 month from the date of receiving the application:
In case the application is valid: Issue a decision accepting the valid application;
In case the application is invalid: Issue a notice of intention to refuse the application, requesting the applicant to supplement or correct deficiencies within 02 months from the date of issuance of the notice.
Step 4: Publish the application in the Industrial Property Gazette within 02 months from the date the application is accepted as valid
Step 5: The Intellectual Property Office examines the content of the application within a period not exceeding 09 months from the date of application publication
Step 6: Issue a decision to grant or refuse to grant the trademark registration certificate, the resolution results are as follows:
In case the application meets protection conditions: The Intellectual Property Office issues a notice of intention to grant the trademark registration certificate;
In case the application does not meet protection conditions: The Intellectual Property Office issues a notice of intention to refuse to grant the trademark registration certificate. The applicant proactively sends an official dispatch, providing grounds for their trademark to be granted a diploma.
Necessary factors to successfully register a trademark for cup and mug products?
To successfully register a trademark for cup and mug products, the following conditions must be met:

It is a visible sign in the form of letters, words, drawings, images, three-dimensional figures, or a combination of those elements, represented by one or more colors or sound signs representable in graphical form;

Based on Article 93 of the Law on Intellectual Property 2005, amended and supplemented in 2022, the trademark protection term for cup and mug products is 10 years, from the date of issuance of the trademark registration certificate to 10 years after the filing date. The trademark owner can renew multiple consecutive times, each time for ten years. The trademark owner is only protected for the trademark of cup and mug products within the territory of Vietnam if registering for trademark protection in Vietnam. In case the trademark owner registers for international trademark protection under the Madrid Protocol and Agreement, the trademark is protected within the territory of the designated country.
