    Step 1: Research the trademark and apply it to the National Office of Intellectual Property

During a preliminary search of the trademark, there were no signs of similarity with the registered trademark. Clients should carry out informal search procedures at the National Office of Intellectual Property through a Viet An Law representative to best evaluate the protection ability of the trademark. The search procedure through a representative takes 1-3 working days.

    Individuals and organizations can apply for trademark registration through the following forms:

    • Individuals and organizations can submit applications through the postal system to the headquarters of the National Office of Intellectual Property or the Representative Office of the National Office of Intellectual Property.
    • Individuals and organizations can apply for trademark registration online: Applicants need to have a digital certificate and digital signature, register an account on the Online Application Receiving System.

    When the application is submitted, the applicant must pay the registration fee to the National Office of Intellectual Property and the trademark registration fee (1 trademark / 1 class of goods and services) as follows:

    • Application fee: 150,000 VND
    • Application publication fee: 120,000 VND
    • Substantive examination fee: 550,000 VND/01 class of goods and services

    Note: Fees and charges may increase in case of registration for multiple classes of goods and services, and in the case of the 7th good or service or more in a class.

    Step 2: Formality and substantive examination of the application

    From the date it is received by the National Office of Intellectual Property, the trademark registration application is considered in the following order:

    • Formality examination: 01 month.
    • Publication of application: within 02 months from the date the trademark application has a Decision accepting the valid application.
    • Substantive examination: no more than 09 months from the date of publication of the application.

    Note: Each application can only request one protection title and the type of protection title requested must be consistent with the trademark stated in the application; All application documents must be made in Vietnamese. All documents must be presented vertically (only drawings, diagrams, and tables can be presented horizontally) on one side of A4 paper (210mm x 297mm), with margins on all four sides, each margin is 20mm wide, in Times New Roman font, letter size no smaller than 13, except for supporting documents whose origin is not intended to be included in the application.

    Step 3: Notify intention to grant/refuse to grant protection title

    At the end of the substantive examination period, the National Office of Intellectual Property issues a notice of intention to grant or refuse to grant a trademark protection title and clearly states the reasons. If the applicant does not agree with the NOIP’s viewpoint, within 02 months from the date of signing the Notice, the applicant can make an Official Letter responding to the above notice with their opinions. In addition, add additional documents to prove and defend your point of view.

    Step 4: Pay the fee for the trademark registration certificate

    After notification of intention to issue a trademark, the applicant pays the fee for granting a trademark certificate.

    The National Office of Intellectual Property issues and publishes the Trademark Registration Certificate to the owner within 01-02 months from the date of payment of the fee for granting the Trademark Registration Certificate.

    Note: In case of submitting a trademark application by post, the applicant needs to transfer money through the post office service, then photocopy the Money Transfer Receipt and send it along with the application to one of the following locations: Receive the above application from the National Office of Intellectual Property to prove the amount paid. When transferring state fees to one of the above application receiving points of the National Office of Intellectual Property, the applicant needs to send the dossier via the corresponding post office to that application receiving point.

    • Documents proving priority rights (if the application claims priority rights).
