Trademark registration certificate renewal fees

According to Article 93.6 Law on Intellectual property, a trademark registration certificate is valid from the date of issuing to the end of ten years from the submitting date. It shall be renewable for successive 10 years.

In order to be granted an extension of the validity of the trademark registration Certificate, within 06 months before the expiration of the Certificate, the holder shall submit an application for renewal to the Intellectual Property office. Intellectual and renewal fee consists of: fee for assessment of a request for an extension, fee for renewing validity of a protection title, a fee for using a protection title, a registration fee and a fee for announcing the decision to extend the validity of a protection title.

The application for extension shall be submitted later than the specified time limit above but not later than 06 months from the date the Certificate of trademark registration expires. The holder shall pay an extension fee, that fee plus a 10% renewal fee for each late payment month.

Protection title validity extension documents include:

• Declaration to request validity extension of protection title, which is written to form 02-GH/DTVB in Appendix C of Circular No.01/2007/TT-BKHCN;
• Original protection title (in case of requesting recognition of extension in protection title);
• Power of attorney (if the application is submitted through a representative);
• Receipt of fee payments and charges.

Regarding charges to extend the validity of  the certificate:

According to Points 3.1 Section A, 1.6, 4.1, 4.2, 5.1 Section B, Circular No.263/2016/TT-BTC dated November 14th, 2016 of the Ministry of Finance regulating the rates, collection and payment, management and using of industrial property charges and fees for renewing the validity of a mark registration certificate, specificially as follows:

• Fee for extension of validity of protection title: 100.000 VND/groups of products and services (Trademark Registration Certificate);
• Fee for assessment of a request for extension of validity of protection titles: 160.000 VND/protection title;
• Fee for publication of information about the industrial property: 120.000 VND/application for extension of validity of protection title;
• Fee for registration of information about the industrial property: 120.000 VND/protection title;
• Fee for using protection title: 700.000 VND/group of products and services.

The cost of the procedure service fee will increase if it is submitted through the representative:

Documents need to be prepared when doing trademark renewal procedures in Viet An Law:

• Power of attorney (attached form);
• Original trademark protection title.

Time to carry out these procedures: 02 – 04 months from the date of submitting the application to the Intellectual Property office. However, it depends on the number of submitted applications at that time.

Result: Intellectual Property shall issue a decision to extend, record it in the protection title, register it, and publish it in the Industrial Property Official Gazette.
