Trademark protection title validity extension directly at VNOIP
Owning an exclusive and legally protected trademark is something that every business wants. Trademarks not only help your products stand out in the market, but also build trust for customers. However, the period of trademark protection is also limited. In order to continue using trademarks and prevent acts of trademark imitation and counterfeiting, it is extremely important to renew the validity of protection title. Viet An Law would like to guide customers on the preliminary procedures for submitting a dossier for renewal of the validity of a trademark protection title directly at the Vietnam National Office of Intellectual Property (VNOIP) through the article below.

Validity of trademark protection title in Vietnam
According to Clause 6, Article 93 of the Intellectual Property Law, it is stipulated as follTows:
“A trademark registration certificate is valid from the date of issuance to the end of ten years from the date of filing, and may be renewed many times in a row, each time for ten years.”
Thus, a trademark protection title is valid for 10 years, if there is a need to use it, the applicant should pay attention to submitting a dossier of renewal of the validity of the trademark protection title.

Note: In a dossier, it is possible to request an renewal of the validity of one or more protection title if there is the same type of object and the same owner.
From August 10, 2025, the National Office of Intellectual Property will implement a mechanism of prioritizing the receipt and processing of applications submitted through the online method for administrative procedures in the field of intellectual property and at the same time, gradually move towards only accepting online applications, completely replacing the form of paper application.
The National Office of Intellectual Property will support organizations, businesses, and individuals to declare and submit tax returns online via the official Zalo channel or directly at the Department’s headquarters, Representative Office in Ho Chi Minh City, and Representative Office in Da Nang City.
In case of late filing of an application for Trademark protection title validity extension directly at VNOIP
Within 6 months before the expiration of the trademark protection title, you need to submit a dossier for renewal of the trademark protection title. However, if the renewal is delayed, you can still submit a request for a renewal but not more than 6 months of the expiration and pay an additional late renewal fee.
Dossier for renewal of the trademark protection title
Declaration of request for renewal of the validity of the protection title (Form No. 07 specified in Appendix II issued together with Decree 65/2023/ND-CP);
The original of the trademark registration certificate (in case the protection title is granted in paper form and there is a request to record the renewal in the protection title);
Power of attorney (in case of requesting filing an application through an intellectual property representative);
Copy of fee and charge payment document: In case of late renewal of validity (for each month of late payment), the fee will be 10% of the maintenance/renewal fee
Time limit for processing dossiers for for renewal of the trademark protection title
Within 01 month from the date of receipt of the dossier of request for renewal, there will be the following 2 cases:
In case the dossier is valid, the NOIP shall issue a decision to renew the validity of the protection title, record it in the protection title (if so requested), register and announce the decision on renewal of the validity of the trademark registration certificate in the Official Gazette of Industrial Property within 60 days from the date of issuance of the decision.
The National Office of Intellectual Property shall issue a notice of intention to refuse the renewal, clearly stating the reason and fixing a time limit of 02 months from the date of issuance of the notice for the requester to correct errors or raise objections in one of the following cases:
The dossier of request for renewal is invalid or submitted in contravention of the prescribed procedures;
The applicant for renewal is not the owner of the corresponding trademark registration certificate.
If, at the end of the fixed time limit, the requester fails to correct the deficiencies or corrects the defects unsatisfactorily, has no objection or raises objections but is not reasonable, the State management agency in charge of industrial property rights shall issue a decision to refuse to renew the validity of the trademark registration certificate.
Some other fees related to procedures forfor renewal of the trademark protection title
Fee for renewal of the validity of a protection title for a trademark (10 years) for each group of products/services: 100,000 VND. From 01/07/2025 to the end of 31/12/2027: 50,000 VND; from 01/01/2028 onwards: 100,000 VND.
Fee for appraisal of renewal request: 160,000 VND.
Fee for using a protection title for a trademark (10 years) for each group of products/services: 700,000 VND.
Fee for publication of the Decision on renewal of the validity of the protection title: 120,000 VND.
Registration fee for the Decision on renewal of the validity of the protection title: 120,000 VND.
Notes on stopping receiving applications for some administrative procedures 01/7/2025
From July 1, 2025, the NOIP shall stop receiving applications for the implementation of the following administrative procedures:
Procedures for issuance of an industrial property representation service practice certificate (TTHC code: 1,011,922);
Procedures for re-issuance of the Industrial Property Representation Service Practice Certificate (TTHC code: 1,011,923);
Procedures for revocation of the Industrial Property Representation Service Practice Certificate (TTHC code: 1,011,924);
Procedures for recording industrial property representatives (TTHC code: 1,011,925);
Procedures for recording organizations eligible to provide industrial property representation services (TTHC code: 1,011,926);
Procedures for recording changes in information of industrial property representation service organizations (TTHC code: 1,011,927);
Procedures for deletion of the name of the industrial property representation service organization (TTHC code: 1,011,928);
Procedures for deletion of the name of the industrial property representative (TTHC code: 1,011,929);
Procedures for registration to participate in the professional examination of industrial property representation (TTHC code: 1,011,921);
Procedures for issuance of industrial property assessor cards (TTHC code: 1,011,931);
Procedures for re-issuance of industrial property assessor cards (TTHC code: 1,011,932);
Procedures for revocation of industrial property assessor cards (TTHC code: 1,011,933);
Procedures for registration for professional examination of industrial property assessment (TTHC code: 1,011,930);
Procedures for granting a copy of a protection title and re-issuance of a protection title/duplicate of a protection certificate (TTHC code: 1.011912);
Procedures for registration of contracts for transfer of the right to use industrial property objects (TTHC code: 1.011914);
Procedures for recording the modification of contents, renewal or termination before the validity period of the contract for licensing the industrial property object (TTHC code: 1.011915);
Procedures for issuance of duplicates and re-issuance of certificates of registration of contracts for transfer of the right to use industrial property objects (TTHC code: 1.011918);
Procedures for issuing a decision on compulsory transfer of the right to use an invention (TTHC code: 1.011916);
Procedures for requesting the termination of the right to use an invention under a compulsory decision (TTHC code: 1.011917). Organizations and individuals wishing to carry out the above-mentioned procedures shall submit dossiers to provincial-level People’s Committees as prescribed.
Applications for implementation of the above procedures have been submitted to the National Office of Intellectual Property before July 1, 2025 but have not yet been settled by the National Office of Intellectual Property to continue to be handled according to regulations.
