Vacuum Cleaners Trademarks Registration in Vietnam

Vacuum cleaners are not popular in Vietnam much, but it is effective for cleaning, especially for materials such as carpets, wools, dirt corners that can not be cleaned by regular broom. To create trust with customers, the business owner of this product can register for trademark protection at the Intellectual Property office. The registration process can be summarized as follows:

Trademark registration classification:

         Trademarked products need classifying according to the Nice Classification. Vacuum cleaners are classified in class 07. Besides, class 07 includes the vacuum cleaner parts such as trash holders, vacuum cleaner hoses, brushes for vacuum cleaners…

A trademark registration dossier includes:

• A trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
• A list of services/goods intended to register;
• A trademark registration declaration (if customers authorize Viet An Law to submit the application, this declaration will be signed by the representative of Viet An Law);
• A power of attorney Viet An Law to submit the application;
• Receipts of fee payment.

Processing the application stages:

• Form appraisal period: 01 – 02 months;
• Publish the application on the gazette: 02 months;
• Content appraisal period: 09 – 12 months;
• Grant and publish the protection title to the owner: 01 – 02 months.

A protection title is valid from the date of granting to the end of 10 years from the submitting date, it can be renewed for successive 10 years. However, it is important to note the extension period procedure and the payment of the renewal fee.

Besides, before submitting the trademark registration application, customers can perform the procedures for evaluating the possibility of trademark registration. Viet An Law will conduct a free preliminary search for customers within 01 days whether the trademark sample is duplicated, confused with other trademarks, or not. In order to have the most general and comprehensive assessment, customers can choose to conduct an in-depth search service of Viet An’s representative at the Intellectual Property Office but customers need to pay a fee.
