    Trademarks are signs that distinguish one business’s goods or services from other businesses. Before using a trademark, the applicant should check the Trademark List to ensure no one else has registered a trademark that is the same or similar to the applicant’s trademark for the same or similar types of goods and services.

    Conditions for trademark registration in Saint Vincent and the Grenadines

    Uniqueness: A  business’s trademark must be able to distinguish its goods or services from those of other businesses. This means that it cannot be generic, descriptive or similar to existing trademarks.

    Pre-registration search: A Trademark List search should be conducted before submitting an application. This ensures that no one else has similar trademarks for the same or similar types of goods/services.

    Unlike another Business Name: A business’s trademark can’t be the same or similar to the name of another business operating in the same or similar industry.

    Types of trademarks that can be registered in Saint Vincent and the Grenadines

    Saint Vincent and the Grenadines follows the international trademark registration system and allows the registration of many different types of trademarks including:

    • Words: Include the brand name, slogan, and any word combinations that identify the origin.
    • Logo: Include designs and icons that uniquely represent your brand.
    • Incorporated: You can apply for a combination of words and logos for a more comprehensive trademark.
    • Images and Icons: Include separate two-dimensional icons and graphic elements that represent your brand.
    • Letters: Trademarks may consist of only letters, but they need to be distinctive enough to function as an identification of origin.
    • Images, Drawings, Diagrams: Include different two-dimensional designs that represent your brand.
    • Slogan and Last Name: You can register your slogan and even your last name as a trademark, although specific rules may apply.
    • Audio: Theoretically, sounds like promotional music can be registered as a trademark, although this may be less common.

     

    Trademark records in Saint Vincent and the Grenadines

    Applicant Information:

    • Applicant name and address: The legal name and full contact information of the applicant, including phone number and email.
    • Type of applicant: Indicates whether the applicant is an individual, company, or other legal entity. (Examples: Sole Proprietorship, Partnership, etc.)

    Trademark Information:

    • Images that represent trademarks: These can be image files (JPEG, PNG) or a clear and detailed description of the trademark (lettering, logo, design, etc.).
    • Class of goods and services: A clear and specific list of the goods or services the applicant intends to use the trademark. Applicants can use the International Classification of Goods and Services (also called the Nice Classification for goods and the Vienna Classification for services) for ease of reference. These classification systems classify products and services, making it easier for the Trademark Office to review an applicant’s application.

    After having all the information, the applicant needs to fill out the trademark registration form

    • Statement of Use (Optional): If the applicant has already started using the trademark at SVG, the applicant may submit a statement of use with evidence (e.g. product packaging, marketing materials) to potentially expedite the registration process.
    • Authorization (Optional): If the applicant files through an attorney or intellectual property representative, the applicant needs to provide Authorization to file on the applicant’s behalf.

    How to file for trademark registration in Saint Vincent and the Grenadines

    To file for trademark protection at SVG, customers can apply by the following filing methods:

    • Direct Submission: You can visit the Commercial and Intellectual Property Office (CIPO) directly at First Floor, Brewster’s Building, McCoy Street, Kingstown, St. Vincent & the Grenadines, West Indies to submit your application and related documents.
    • By Post: You may send your application form and all required documents via postal service or courier service to the Trade and Intellectual Property Office (CIPO) at First Floor, Brewster’s Building, McCoy Street, Kingstown, St. Vincent & the Grenadines, West Indies.
