Milk products Trademark Registration in Vietnam

Milk is a product which provides many nutrients for humans and also is especially necessary for young children. On the market nowadays, there are many different milk products and many of them are counterfeited. To protect consumers and create a reputation for manufacturers, a trademark registration in Vietnam for milk products is necessary. The trademark registration process is as follows:

According to the Nice Classification, milk and other milk products is grouped in class 29. This class specifically includes mainly milk products.

After grouping, customers should perform a trademark search to assess the possibility of being protected.

Prepare application and submit the application at the Vietnam Intellectual Property Agent (Office):

  • A trademark template with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of products and services requiring to be registered;
  • A trademark registration declaration (in case the customers authorize the Viet An Law, the declaration will be signed by the representative of industrial property of Viet An Law);
  • Power of attorney (authorize Viet An Law to submit the trademark registration application);
  • Fee payment receipts.

After submitting the application, if the application is valid, the Intellectual Property office will consider receiving and processing the application. Processing time for a trademark registration application includes:

  • Form appraisal: 01 – 02 months;
  • Publish application in the Intellectual Property office’s gazette;
  • Content appraisal: 09 – 12 months;
  • Grant and publish the trademark registration certificate for the owner: 01 – 02 months.

A trademark protection title is valid from the date of issue to the end of 10 years from the submitting, renewable for successive 10 years. However, it is important to pay attention to the grace period procedure and the full payment of the renewal fee.

A renewal request application includes:

  • A requesting extension of validity of protection title declaration;
  • An original trademark registration Certificate (in case of requesting recognition of renewal in the trademark registration Certificate);
  • A power of attorney (in case of submitting through a representative);
  • Fee payment receipts, announcement of the decision on extension fee and registration of the decision to renew the protection title fee in accordance with the law.
