Dependent registration services for foreign individuals in Vietnam

Vietnam is increasingly becoming an attractive destination for foreigners to live and work. Accordingly, the demand for registration of dependents of these individuals is also increasing. The registration of dependents not only helps foreigners enjoy tax and insurance benefits, but also serves as a legal basis for dependents to live legally in Vietnam.     Dependents of foreign individuals in Vietnam

    • Children: natural children, legally adopted children, illegitimate children, stepchildren of the wife, stepchildren of the husband, specifically:
    • Children under 18 years old (calculated by month). Example 10: Mr. H’s child born on July 25, 2014 shall be counted as a dependent from July 2014.
    • Children aged 18 years or older who are disabled and unable to work.
    • Children who are studying in Vietnam or abroad at university, college, vocational high school, vocational school, including children aged 18 years or older who are studying at the high school level (including the period of waiting for university exam results from June to September of grade 12) have no income or have an average monthly income in the year from all sources income does not exceed VND 1,000,000.
    • Spouse of a taxpayer

    The taxpayer’s spouse is only considered as a dependent if it meets the conditions in Section 3.

    • Father and mother; father-in-law, mother-in-law (or father-in-law, mother-in-law); stepfather, stepmother; the taxpayer’s lawful adoptive father or adoptive mother meets the conditions in Section 3.
    • Other helpless individuals that taxpayers are directly nurturing and meet the conditions in Section 3 include:
    • Siblings, sisters, siblings of taxpayers.
    • Grandfather and grandmother; grandfathers, grandmothers; biological aunts, biological aunts, biological uncles, biological uncles of taxpayers.
    • Taxpayers’ nephews include: children of brothers, sisters, siblings.
    • Persons who must directly nurture others as prescribed by law.

    Eligibility to be counted as a dependent

    An individual who is counted as a dependent must meet the following conditions:

    • For people of working age, the following conditions must be met at the same time:
    • Being disabled, unable to work.
    • Disabled and unable to work are those who are governed by the law on disabled persons, people suffering from diseases that are incapable of working (such as AIDS, cancer, chronic kidney failure,…).
    • Have no income or have an average monthly income in the year from all sources of income not exceeding VND 1,000,000.
    • For persons outside the working age, they must have no income or have an average monthly income in the year from all sources of income not exceeding VND 1,000,000.

    Dependent registration services for foreign individuals in Vietnam by Viet An Law

    In case of registration of dependents for the first time

    Step 1. Gathering Records and Related Information

    • The client provides information on dependents according to form No. 02/DK-NPT-TNCN and submits two (02) copies to the income-paying organization or individual as a basis for calculating deductions for dependents for Viet An Law
    • Documents proving dependents
    • Signing the power of attorney for Viet An Law

    Step 2. Submission of registration dossiers at tax authorities

    Viet An Law shall submit one (01) dependent registration form according to form No. 02/DK-NPT-TNCN to the tax authority directly managing the income-paying organization at the same time as submitting the personal income tax return of that tax declaration period in accordance with the Law on Tax Administration.

    In case of registration of change of dependents

    Step 1. Gathering Records and Related Information

    • Customers shall supplement the changed information of dependents according to form No. 02/DK-NPT-TNCN and submit it to the income-paying organization or individual or the tax authority for taxpayers who are subject to tax declaration directly to the tax authority.

    Step 2. Submit your application

    • Location: the tax authority shall submit it to the tax authority directly managing the income-paying unit.
    • Time limit for submission of dossiers proving dependents: within three (03) months from the date of submission of the declaration for registration of dependents (including the case of registration of change of dependents). Past the deadline for submitting the above-mentioned dossier, if the customer fails to submit the dossier proving the dependent, the dependent will not be deducted and the payable tax amount must be adjusted.
