Classification of trademark registration for nutritional cereal in Vietnam
Class 05:
Dietary foods used in medicine; nutritional supplements used in medicine; food for infants; Medical preparations used to slim the body; drinks forbidden for use in the medical profession; functional foods containing herbs or herbal extracts for medical purposes.
Class 29:
Milk is made from grains; milk and milk products; yogurt; Fast food with ingredients mainly from vegetables and fruits (snacks); and Nutritious foods made from herbs.
Class 30:
Grain; cereal; ice cream (ice cream); nutritional powder (not for medical purposes); porridge of all kinds; herbal teas of all kinds (tea-based drinks); drinks extracted from herbs (not for medical purposes).
Class 35:
Import, export, trade: dietary foods, nutritious seeds, nutritious cereal powder.

Step 1: Choose a trademark and goods and services for the trademark
•	Trademark selection: Choose a trademark model that meets protection standards. The selected trademark is not similar to other registered trademarks or famous trademarks.
•	Select a class of goods and services bearing the trademark according to the Nice International Classification.
Step 2: Research the trademark
Documents need to be prepared when searching for trademarks
To perform a trademark search, clients only need to provide Viet An Law:
•	Trademark sample;
•	List of goods and services that need to be searched and registered.
Step 3: Submit the registration application
•	After a profound search and the trademark is assessed as capable of registration, the applicant proceeds to submit the registration application.
•	Agency receiving and processing documents and collecting registration fees in Vietnam: National Office of Intellectual Property.
Step 4: Formality examination of the registration application
•	The time limit for the formality examination of a trademark application is 01 month from the date of application submission.
•	The National Office of Intellectual Property will consider whether the application meets the requirements in terms of form, trademark sample, application owner, filing rights, classing, etc.
•	If the business's registration application meets the conditions. The National Office of Intellectual Property will issue a Notice of acceptance of the valid application and publish the application.
•	If the business's registration application does not meet the conditions. The National Office of Intellectual Property will issue a Notice of non-acceptance of the application and request the enterprise to make amendments. The application owner and representative of the application owner shall make amendments as requested. After that, submit the amended dispatch to the National Office of Intellectual Property and pay additional fees if the class is classified incorrectly.
Step 5: Publication of the application
•	The time limit for publication of the trademark application is 02 months from the date of notification of acceptance of the valid application.
•	The application publication content includes information about the valid application recorded in the notice of acceptance of the valid application, trademark sample, and list of goods and services.
Step 6: Substantive examination of the application
•	The time limit for substantive examination is 09 months from the date of publication of the application.
Step 7: Pay the fee for granting a certificate of protection
After receiving notice of intention to grant a protection title, the applicant shall proceed to pay the granting fee.
