Yogurt Products Trademarks Registration in Vietnam

 Yogurt is a product made of fermentation from milk, it brings many benefits to human health and beauty benefits. Yogurt not only boots the immune system, helps with weight loss, keeps shape, but also is good for digestion. Currently, many yogurt trademarks are appearing in the market such as Vinamilk, TH True Milk, Ba Vi,… To compete with such famous trademarks, new business owners, who want to enter the market, need to build a strategy for themselves to gain consumer’s trust. Enterprises shall consider trademark registration to promote their products and distinguish their goods from counterfeit goods in the market.

Yogurt Products Trademarks Registration in Vietnam

The trademark registration process can be summarized as follows:

Trademark registration class classification:

         Trademarked goods/services are required by law to be classified according to the Nice Classification. This is a compulsory procedure for a trademark registration application. It can be classified by the applicant or classified by the Intellectual Property office (there is a fee). Yogurts are classified in Class 29.

Search for a trademark:

         Customers can choose trademark searching services of Viet An Law to evaluate the possibility of registration:

  • Preliminary search: customers send the trademark intended to register to Viet An Law. We will conduct a preliminary search within 01 days.
  • Search at the Intellectual Property office through representative of Viet An Law: customers should perform this step to evaluate the highest possibility of registration. It takes 01 – 03 working days to perform.

Prepare a dossier including:

  • A trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of services/goods intended to register;
  • A trademark registration declaration (if customers authorize Viet An Law to submit the dossier, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney Viet An Law to submit the dossier;
  • Receipts of fee payments.

Submit and monitor the application:

The trademark registration application will be submitted at the Intellectual Property rights. It takes 13 – 18 months including the Form appraisal stage; Publish the application on the gazette; Content appraisal stage; Grant and Publish the protection title.

A protection title is valid from the date of granting to the end of 10 years from the date of submitting, it can be renewed every 10 years. Please notice that renewal must be submitted to the Intellectual Property Office within 06 months before the expiration of the certificate of trademark registration. The renewal application may be submitted later than the specified time limit above but not later than 06 months from the date of expiration.
