Vehicle Rental Services Trademarks Registration in Vietnam
In modern life today, due to the nature of work or needs, the traveling of people takes place continuously. However, people do not always have the right means of transport so rental services in this area are quite developing. For business entities, to avoid being infringed on their reputation and prestige, they can refer to the following trademark registration procedures:
Preparing documents and drafting dossier includes:
A trademark sample with dimension bigger than 3 x 3 cm and smaller than 8 x 8 cm;
A list of goods/services intended to register (goods/services are classified in class 39 according to the Nice Classification);
A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
A power of attorney;
Receipts of fee payments.
Registration process:
Submit the dossier at the Intellectual Property office;
Form appraisal: 01 months from the date of submitting;
Publish the trademark registration: 02 months from the date of receiving notice to accept as a valid application;
Content appraisal: 09 – 12 months from the date of publishing;
Grant the protection title: 02 – 03 months from the date of paying a granting fee.
A protection title takes effect from the date of issue and is valid for 10 years from the date of submission. Upon expiration, the owner can make the renewal (10 years each) and pay a fee. After receiving the protection title, the owner has the full right to use or let others use it within the protected area. Trademarks can be used through the follows:
Affixing protected trademark on goods, goods packaging, means of business, means of services, documents of transactions in business activities;
Circulating, offering for sale, advertising for the sale, stockpiling for sale of goods bearing the protected trademark;
Import goods/services bearing the protected trademark.
