Transport Services Trademarks Registration in Vietnam

 Transport is a necessary industrial service. It also has a large number of customers. The objects of transport service are not only people but also goods. Goods transports account for a large proportion. In transport, there are 3 popular types of transportation including road transport, sea transport, and air transport. Due to market demand, there are more and more transport companies business to attract customers. One of these things is reputation. Therefore, businesses with transport brands and trademarks need to register their exclusive trademarks to avoid being counterfeited.

Transport service trademark registration

Viet An Law would like to consult customers wishing to do business in transport services about orders and procedures for trademark registration & Vietnam intellectual property in Vietnam.

          First, transport services are underclass 39 according to the Nice Classification.

          Orders, procedures for transport services trademark registration include:

Step 1: Submit the trademark registration

          Individuals, organizations can directly submit at the competent state agency or can submit through the representative of Viet An Law. When submitting, customers shall pay the registration fee and take these receipts to submit.

          Attach with trademark registration application, customers need to provide these following documents:

  • A list of goods/services intended to register;
  • A trademark registration declaration;
  • A power of attorney Viet An Law to apply;
  • 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • Receipts of fee payments.

Step 2: Receive and consider the trademark registration application

          The application is received by the competent state agency in charge of industrial property if it meets the information and documents requirements according to Clause 1 Article 108 the Law on Intellectual Property 2005.

          After receiving, the agency continues to consider through the following stages:

Stage 1: Form appraisal

          The form application is appraised to evaluate the validity including necessary documents; classification; stated objects classification; right to submit;… If the application is valid, the agency will issue a notice to accept it as a valid application. Then, the agency will perform procedures for granting the protection title and record it on the National Register of Industrial Property. If the application is one of the cases as prescribed in Clause 2 Article 109 the Law on Intellectual Property, the agency will issue a refusal notice (clearly state reason).

          The period time to appraise form is 01 month from the date of submitting.

Stage 2: Publish the application

          The accepted application will be published on the gazette within 02 months from the date of acceptance.

Stage 3: Content appraisal

The application is not one of the refusal cases as prescribed in Clause 1, Clause 2 and Point b Clause 3 Article 117 the Law on Intellectual Property and the applicant pay the fee, the agency in charge of industrial property will issue a notice to grant the protection title and record it on National Register of Industrial Property.

          Period time is 01 – 02 months from the date of paying the fee.

Notices: Before submitting, to ensure the possibility of protection, customers can use the search of Viet An Law including:

  • Preliminary search: Viet An Law will conduct a preliminary search for provided trademark within 01 days from the date of receiving.
  • Search at the Intellectual Property office: Viet An Law will through the representative search for a trademark at the Intellectual Property office. This step helps to evaluate the strongest possibility of protection.

After having results, Viet An Law will notify customers and consult to complete and submit as soon as possible. Viet An Law provides customers with the best trademark registration services.
