Security Services Trademarks Registration in Vietnam

Currently, due to several needs, many subjects have needs to use security services. They can use the service to ensure personal safety or to ensure security for organizations and businesses. For many businesses, using security will help to save costs compared to signing a labor contract with each employee. However, security services must be reputable to attract customers. To do that, the business owner can apply for trademark protection.

Before submitting the trademark registration application:

  • Design a trademark sample:

A trademark sample can be presented in the form of text, images, or a combination of elements. However, a trademark must not be identical or confusingly similar to a protected trademark model; must not be identical or confusingly similar to the national flag, national emblem, name of the state agency, armed unit, name of a celebrity or leader.

The color of the trademark sample can be in the form of black-and-white or color trademark. However, when registered as black-and-white, the owner can use the trademark in a different color and still be protected.

According to the Nice Classification, security services are underclass 45 including Personal bodyguard, Security, Nightguard, Security consultant,…

  • Prepare trademark registration dossier:
    • A trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
    • A list of goods/services intended to register;
    • A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
    • A power of attorney Viet An Law to submit;
    • Receipts of fee payments.

Submit and monitor the process:

  • Receiving application place: the Intellectual Property Office in Vietnam;
  • Process time to consider the application: 13 – 18 months including:
    • Form appraisal;
    • Publish the application on the gazette;
    • Content appraisal;
    • Grant and Publish the protection title.

After being granted the protection title: The protection title is valid for 10 years from the date of submission. Upon the expiration of the above period, the owner shall conduct the renewal of the protection title and pay the renewal fee.

A protection title renewal dossier includes:

  • A renewal request declaration (form 02-GHVB prescribed in Appendix C of this Circular);
  • The original protection title (in case of requesting to record the renewal);
  • A power of attorney (in case of submitting through the representative);
  • Receipts of fee payments.
