Receiving dossiers of trademark validity renewal at the NOIP Vietnam

In order to be granted a trademark protection renewal, the owner of the Trademark Certificate must file an application for trademark renewal at the NOIP. The NOIP is the agency competent to receive, process and issue decisions to renew the validity of protection titles. So how is the time limit for receiving and processing trademark renewal applications regulated? In the following, Viet An Law will analyze the notes in the process of receiving trademark validity renewal dossiers at the NOIP.

    What does a trademark validity renewal dossier include?

    Trademark validity renewal dossier

    According to Clause 2, Article 31 of Decree 65/2023/ND-CP, a dossier of request for renewal of the validity of the Trademark Registration Certificate includes the following documents:

    • The declaration for renewal of validity shall be made according to Form No. 07 in Appendix II of Decree 65/2023/ND-CP;
    • The original of the trademark registration certificate (in case the protection title is granted in paper form and there is a request to record the renewal in the protection title);
    • Power of attorney (in case the request is submitted through a representative);
    • A copy of the charge and fee payment receipt (in case of payment of charges and fees by postal service or directly into the account of the state management agency in charge of industrial property rights).

    Note: In a dossier, it is possible to request an renewal of the validity of one or more protection titles if there is the same type of object and the same owner.

    Time to submit a trademark validity renewal dossier

    Pursuant to Clause 3, Article 31 of Decree 65/2023/ND-CP, within 06 months before the expiration date of the trademark registration certificate, the protection title holder must carry out procedures for renewing the validity of the trademark registration certificate.

    The dossier of request for renewal may be submitted later but must not exceed 06 months from the date the trademark registration certificate expires.

    Note to submit an application for renewal of trademark validity online from 10/08/2025

    Previously, a trademark validity renewal dossier was submitted to the NOIP by one of the following methods:

    • Form of paper application: The applicant can submit the trademark renewal dossier directly or through the service of the post office to one of the application reception points of the National Office of Intellectual Property.
    • Online application form: Applicants submit online through the online public service portal of the National Office of Intellectual Property of Vietnam at the link: https://dichvucong.ipvietnam.gov.vn

    However, it should be noted that from August 10, 2025, in order to improve the efficiency of using online public services, promote the reduction and simplification of administrative procedures and promote digital transformation in the agency’s operations, the NOIP will prioritize the receipt of  online dossiers with a lot of administrative procedures, including procedures for renewing the validity of the Trademark Registration Certificate.

    Receiving applications for trademark validity renewal online

    When applying online, it should be noted:

    Eligibility to apply online

    The applicant needs to have a digital certificate and digital signature, register an account on the Online Application Receiving System and have an account approved by the National Office of Intellectual Property to carry out IP right registration transactions:

    Online Application Sequence

    • The applicant needs to declare the dossier and submit the trademark renewal application on the Online Application Receiving System of the National Office of Intellectual Property.
    • After completing the application declaration and submitting the application on the Online Application Receiving System along with full payment documents, the receiving department of the National Office of Intellectual Property will issue the Renewal application number and the date of receipt of the Renewal Application to the applicant.
    • Within 01 month from the date of receipt of the renewal application, the applicant needs to supplement the original dossier to the National Office of Intellectual Property on working days during transaction hours to enclose the original documents to the NOIP (trademark certificate and original authorization if through a representative).

    Time limit for receiving dossiers for renewal of trademark validity at the NOIP

    Time limit for examination of applications

    • 01 month from the date of application
    • Within 01 month from the date of receipt of the dossier of request for renewal, the state management agency for industrial property rights (NOIP) shall consider the dossier and carry out the procedures as prescribed.

    Application Processing Process

    According to Clause 2, Article 31 of Decree 65/2023/ND-CP, the process of processing an application for renewal of trademark validity is carried out as follows:

    Time limit for processing dossiers for renewal of trademark validity at the NOIP

    In case the application is valid

    • To issue decisions on renewal of the validity of protection titles;
    • Recording in the protection title (if so requested)
    • Register and announce the decision on renewal of the validity of the Trademark Registration Certificate in the Official Gazette of Industrial Property within 60 days from the date of issuance of the decision;

    In case the dossier is invalid

    Cases of invalid dossiers include:

    • The dossier of request for renewal is invalid or submitted in contravention of the prescribed procedures;
    • The applicant for renewal is not the owner of the corresponding trademark registration certificate.

    Accordingly, if it falls into one of the above cases, it shall be handled as follows:

    • Issue a notice of intention to refuse the renewal, clearly stating the reason and fix a time limit of 02 months from the date of issuance of the notice for the requester to correct errors or raise objections
    • If at the end of the set time limit, if the requester fails to correct the deficiencies or corrects the defects unsatisfactorily, has no objection or has an objection but is not valid, the NOIP shall issue a decision to refuse to renew the validity of the trademark registration certificate.

    Results of carrying out procedures

    • Issue a decision to record the renewal of the validity of the protection title and publish it in the Official Gazette of the IP or the Decision on refusal to renew the validity of the protection title.
    • Update the renewal contents in the original protection title (if any) and return the title to the owner.

    Note: In case the owner of the trademark registration certificate requests the NOIP to record the decision to renew the validity of the protection title, the protection title holder must carry out the procedures for amending the protection title and pay fees and charges as prescribed.

    Notes not to be rejected when receiving a trademark validity renewal dossier at the NOIP

    • Trademark renewal dossier: all components of the dossier must be submitted according to Clause 2, Article 31 of Decree 65/2023/ND-CP.
    • Time of submission: The dossier of request for renewal of the Trademark Registration Certificate must be submitted within 06 months from the date the Trademark Registration Certificate expires. Requests for renewal may be submitted after the above-mentioned time limit but must not exceed 06 months from the date on which the protection title expires and the protection title holder must pay a fee for each late month.
    • Subject with the right to renewal: The applicant for renewal must be the owner of the corresponding trademark registration certificate. The owner of a trademark registration certificate shall be determined according to the information issued on the trademark registration certificate. In case of filing an application through a representative, a written power of attorney is required. A power of attorney without an authorization term is considered to be valid indefinitely and only terminates when the authorizing party declares the termination of the authorization.
    • Fees and charges for renewal: It is necessary to pay fees and charges for trademark validity renewal in accordance with the provisions of Circular 263/2016/TT-BTC, including: Fee for renewal of validity; Late validity renewal fee (if any); Fee for appraisal of request for renewal; Usage fee; Fee for publication of the Decision on recognition of renewal; Registration fee of the Decision on renewal of the validity of the protection title.

    Note: According to Circular 43/2024/TT-BTC, from July 1, 2025 to the end of December 31, 2026, the fee for filing an application for registration of intellectual property rights is reduced by 50% according to Circular 263/2016/TT-BTC.
