Flashlights Trademarks Registration in Vietnam

Flashlights is a compact, convenient lighting device to use when moving or using in places without light. Currently, most flashlights are rechargeable instead of using batteries. As a result, the advantage of this product is its longer lifespan compared to battery-operated products. For many manufacturers who want to protect their products, they can refer to the following trademark registration procedures:

Flashlights Trademarks Registration in Vietnam

Prepare trademark registration dossier:

  • Trademark samples with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of services/goods intended to register.

Flashlights are classified in class 11 according to the Nice Classification.

Notices: If the applicant does not classify goods/services or wrongly classify, the Intellectual Property Office shall classify and the applicant shall pay the classifying fee.

  • A trademark registration declaration (if customers authorize Viet An Law to apply, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney Viet An Law to apply;
  • Receipts of fee payment.

Apply at the Intellectual Property office:

         Customers can directly submit themselves or through the representative of Viet An Law. After the assessment, the Intellectual Property Office will accept the application.

Form appraisal stage (01 – 02 months):

         The Intellectual Property Office will consider the validity of the application (necessary documents; group classification; stated objects classification; rights to apply;…) and issue a notice to accept the application or notice to refuse to accept the application (if the applicant does not amend the application);

Publish the application on the gazette:

         The trademark registration application shall be published within 02 months from the day when the application is accepted as a valid application and the applicant shall pay the publishment fee;

Content appraisal (09 – 12 months):

         The purpose of the content appraisal is to assess the possibility of stated object protection in the application according to the conditions for protection. It also helps to determine the scope of protection. During the content appraisal, the Intellectual Property Office may request the applicant for explaining the content of the application, providing information about the nature of the stated objects in the application.

Grant and publish the trademark registration certificate (01 – 02 months):

         The trademark registration certificate shall be valid from the date of granting to the end of 10 years from the date of submission. At the end of its validity period, the owner can extend for an additional 10 years (an unlimited number of times) and shall pay the fee fully.
