Trademark registration dossier in Cambodia

When customers enter the world of business and commerce in Cambodia, owning a unique and strong brand becomes a decisive factor to the success and long-term vision of a business. A trademark is an important asset for businesses. It helps businesses differentiate their products or services from those of their competitors. Branding also helps businesses build customer credibility and loyalty. To protect their trademarks, businesses need to register their trademarks at the competent authority. The registration of a trademark will help the enterprise be granted a certificate of trademark registration, giving the enterprise exclusive rights to that trademark. A trademark registration dossier is not only a legal document but also an essence that signifies the value, uniqueness and prestige of a brand.   • Full name as well as address of the applicant;
  • Brand samples (20 samples) with dimensions not larger than 80mm x 80mm and not less than 50mm x 50mm;
  • Translation and transcription of the trademark if the mark is not in English;
  • Vienna code of the trademark (if any);
  • Group of goods/services intended for registration;
  • Information on the right-of-way under the Paris Agreement (if applicable), including application number, priority date, country. A certified copy of the priority application and an English translation may be submitted after the application has been submitted;
  • Notarized power of attorney from the applicant. The power of attorney needs to be notarized, consular legalized. A power of attorney may be filed for multiple applications. Photocopies or facsimile copies may be accepted upon application, but originals must then be submitted.

Legal notices of Cambodian trademark registration documents

  • Correct the form prescribed by the trademark registration authority.
  • Provide all necessary information.
  • The documents in the dossier must be consular legalized, if necessary.
  • An application for trademark registration in Cambodia must be filed in Khmer or English.

Note when writing a declaration for trademark registration in Cambodia

Here are some notes when writing a trademark declaration in Cambodia:

  • Double-check the information on the declaration before submitting. Please ensure that all information is filled out completely and accurately, including:
    • Name and address of the applicant.
    • Name and description of the trademark.
    • Protected goods or services.
  • Fill out the declaration form correctly. The trademark declaration in Cambodia comes in two forms: the Khmer form and the English form. Please ensure that customer use the correct declaration form.
  • Complete the trademark ownership information, if any. If customerr trademark was used prior to the date of filing the application, customer will need to provide documents proving ownership of the trademark.
  • Attach English translations of documents, if necessary. If the documents in the trademark application are not written in Khmer or English, customer need to attach an English translation of such documents.

In addition, customers should also note some of the following points when writing a trademark declaration in Cambodia:

  • Trademark names should be memorable, recognizable and not identical or confusingly similar to registered trademarks or trademarks being legally used in Cambodia.
  • Protected goods or services should be clearly and specifically listed.
  • The trademark registration fee should be paid in full as prescribed.
