Scrap suspended from temporary import, re-export, and transit in Vietnam

List of scrap materials temporarily suspended from temporary import, re-export, and transit have regulated by Circular 18/2024/TT-BCT, which was issued by the Ministry of Industry and Trade on October 8, 2024, officially effective for five (05) years from January 1, 2025, to December 31, 2030. This regulation aims to protect the environment, control the quality of imported goods, and ensure economic security. The following article by Viet An Law will provide necessary information related to the list of scrap suspended from temporary import, re-export, and transit in Vietnam for 5 years (2025-2029).

    Scope of application

    Under Article 2 of Circular 18/2024/TT-BCT, the subjects of the application are traders participating in the temporary import, re-export, and transit of goods; organizations and agencies managing temporary import, re-export, and transit of goods and other agencies, organizations and individuals related to temporary import, re-export, and transit of goods.

    The above list of scrap does not apply to cases of transit business in which goods are transported directly from the exporting country to the importing country, without going through Vietnam’s border gates.

    List of scrap suspended from temporary import, re-export, and transit in Vietnam for 5 years (2025-2029)

    Built based on the List of Vietnam’s export and import goods issued with Circular 31/2022/TT-BTC, scrap items that must temporarily suspend temporary import, re-export, and transit business for 5 years include:

    Principles for using the list of scrap suspended from temporary import, re-export, and transit in Vietnam

    Pursuant to the provisions in the Appendix of Circular 18/2024/TT-BCT, the principles for using this list are as follows:

    • Where only a 2-digit code is listed, all 8-digit codes in this Chapter apply.
    • If only a 4-digit code is listed, all 8-digit codes in this 4-digit group will be applied.
    • If only a 6-digit code is listed, all 8-digit codes in this 6-digit subgroup will apply.
    • Some scrap only applies to used goods including:
      • Self-adhesive plates, sheets, film, foil, tape, strips, and other flat shapes, of plastics, whether or not in rolls.
      • Other plates, sheets, film, foil, and strips, of plastics, non-cellular and not reinforced, laminated, supported, or similarly combined with other materials.
      • Other plates, sheets, film, foil, and strips, of plastic.
      • Sacks and bags (including cones) of polymers of ethylene.
      • Sacks and bags (including cones) of other plastics.

    Responsibilities of organizations and individuals importing and using imported scrap as raw materials for production

    Importing and using imported scrap as raw materials for production

    Clause 9, Article 45 of Decree 08/2022/ND-CP specifically stipulates the responsibilities of organizations and individuals importing and using imported scrap as raw materials for production as follows:

    • Import the correct type and quantity of scrap permitted for import as specified in the environmental license or component environmental license: Having an environmental license, which includes the content of using imported scrap as raw materials for production or a component environmental license is a certificate of eligibility for environmental protection in importing scrap as raw materials for production as prescribed in Point d, Clause 2, Article 42 of the Law on Environmental Protection, except for the case specified in Clause 18, Article 168 of this Decree and the case of importing scrap arising from the activities of non-tariff zones, export processing zones, and export processing enterprises.
    • Use all imported scrap as raw materials to produce products and goods according to the provisions of this Decree;
    • Identify and classify waste generated from the process of using imported scrap to have appropriate waste treatment plans;
    • Be responsible before the law for importing and using imported scrap as raw materials for production; coordinate with industry associations to carry out environmental protection work according to regulations; pay all costs for handling imported scrap in violation.
