Procedures for granting an international travel business license

Procedures for granting an international travel business license

To apply for an international travel business license, an enterprise must take the following steps:

Step 1: Prepare license documents

The enterprise prepares 02 sets of documents (of which 01 is kept at the enterprise) according to the list of instructions mentioned below with the corresponding conditions have described in the our previous article “Conditions for establishing a foreign-invested travel company in Vietnam“:

• An application form for an international travel service business license;
• A notarized copy of the Enterprise Registration Certificate or the Investment Registration Certificateissued by a competent state authority;
• Certificate of escrow for travel service business;
• Certified copies of diplomas and certificates of the person in charge of the travel service business as prescribed;
• A certified copy of the appointment decision or the labor contract between the travel service enterprise and the person in charge of the travel service business.

Step 2: Submit a application at the Vietnam National Administration of Tourism

The enterprise submits 01 application to the Vietnam National Administration of Tourism.

Step 3: The Vietnam National Administration of Tourism grant a licence

Within 10 days from the day on which the valid application is received, the Vietnam National Administration of Tourism shall appraise and grant an international travel service business license to the enterprise and notify the tourism authority of the province where enterprise is headquartered. In case of refusal, it must be notified in writing and clearly state the reasons therefor.

Withdrawal of international travel business license

An enterprise shall have revoked its travel services license in the following cases:

• Termination of travel service business, dissolution or bankruptcy;

For the following cases in which the international travel business license is revoked, the procedures for applying for an international travel business license can only be re-submitted after 6 months from the effective date of the revocation decision. Detail:

• Failing to meet one of the prescribed travel service business conditions;
• Do not change the license of travel service business according to specific regulations, businesses that have been granted international travel business licenses before January 1, 2018 at the latest by December 31, 2018 must conduct the following tranferring procedures of the international travel license in accordance with the provisions of the Law on Tourism 2017.

For the following cases where the international travel business license is revoked, the procedures for applying for an international travel business license can only be re-submitted after 12 months from the effective date of the revocation decision. Specifically:

• Harming national sovereignty, interests, national defense or security;
• Exploiting tourism activities to illegally bring people from Vietnam abroad or from abroad into Vietnam;
• Allow other organizations and individuals to use the travel service business license of the enterprise for business activities;
• Failure to fulfill obligations: Applying measures to ensure the safety of tourists’ life, health and property; promptly notify competent state agencies of accidents and risks of consequences causing serious damage to tourists’ lives, health and properties;
• Forging dossiers of application for grant, renewal or re-issuance of travel service business licenses.
