Printers Trademarks Registration in Vietnam

For office activities, it is impossible not to mention the printer. Printers make preparing documents easy and save time. In addition, there are wide varieties of printers for various uses, and a wide range of applications. Some famous printer manufacturers, selected by consumers such as Canon, HP, Epson, Samsung,… For printer businesses, they can register for trademark protection for their products to distinguish them from goods or services of other subjects. Trademark registration can be done as follows:

Printers Trademarks Registration in Vietnam

Classification of trademark registration:

According to the Nice Classification, printer products are classified into class 07, including several products such as 3D printers, printers, art printers, …

A trademark registration dossier includes:

  • A trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of goods/services intended to register;
  • A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney;
  • Receipts of fee payments.

Submit and process the application:

         The place to receive the trademark registration application is the Intellectual Property office. The application processing process takes 13-18 months including Form appraisal; Publish the application on the gazette; Content appraisal; Grant and Publish the application. 

Time to protect a trademark:

         According to the provisions of the Law on Intellectual Property, a Trademark Registration Certificate is valid from the date of issue to the end of ten years from the date of applying and can be extended for ten consecutive years. When customers want to extend the validity period, customers must submit an extension request to the Intellectual Property Office within 06 months before the expiry date of the Certificate of Trademark Registration. In case the application cannot be submitted within the above time, customers can submit later but not later than 06 months from the date the protection title expires. An important condition for the extension is that the owner must pay the renewal fee in full.

         If the trademark is not used by the owner or authorized by the owner for five consecutive years before the date of the request for termination without good cause (unless the use is warranted start or re-start at least three months before the date of the request for cessation of validity) then the protection title will be terminated.
