Oven Products Trademarks Registration in Vietnam

Currently, cooking utensils in the kitchen are increasingly diverse. A familiar utensil, especially for those who love baking, is the oven. For oven manufacturers, it is possible to protect their products in many ways, including trademark registration, which is a common and often chosen method of application. The procedures for trademark registration can be summarized as follows:

Oven Products Trademarks Registration in Vietnam

Trademark registration classification:

The classification must be based on the Nice Classification. If the applicant does not classify or misclassify the NOIP, the Intellectual Property Office will classify and collect the fee. According to the classification, oven products are under class 11.

Submit the trademark registration:

         Trademark owners can apply directly or through a representative of Viet An Law. However, customers need to prepare a complete dossier including:

  • 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of goods/services intended to register;
  • A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney;
  • Receipts of fee payment.

Notices: Trademark registration fees depend on goods/services intended to register.

Form appraisal (01 – 02 months): 

         The form application will be appraised to assess the validity of the application (necessary documents, classification, stated object classification, rights to apply…).

Publish the application on the gazette: 

         The application is accepted as a valid application will be published on the gazette within 02 – 03 months from the date the application is accepted.

Content appraisal (09 – 12 months):

         The content application will be appraised. The purpose of this stage is to assess the strongest possibility to grant the protection title and assess the scope of protection. The time to appraise content is 06 months from the date of publishment. During the content appraisal, the state management agencies in charge of industrial property rights shall request the applicant to explain the content, provide information on the stated objects.

Grant the protection title and publish (01 – 02 months):

From the date on which the Intellectual Property office’s decision to grant a protection title is issued, the owner has full rights to the registered mark and can protect certain trademarks against the infringement of competitors.

A protection title is valid from the date of issue until the end of 10 years from the date of submission. Customers should note that it is necessary to use the trademark after being protected because if it is not used for 5 consecutive years, it will be invalidated (except in the case of law).
