What is a certification trademark?

A certification trademark means a trademark that the trademark owner allows another organization and individual to use on the goods and services of that organization or individual to certify the characteristics of origin, raw materials, materials, how goods are produced, how services are provided, quality, accuracy, safety or other characteristics of goods, services bearing the trademark.

Dossier for registration of the certification trademark

• Registration declaration according to the prescribed form (under form 04-NH specified in Appendix A of Circular No. 01/2007/TT-BKHCN);
• Samples of certification trademarks (05 samples of size 80×80 mm) and a list of goods and services bearing the trademark;
• A description of the feature, quality of character (or specific) of the product bearing the trademark (if the registered trademark is a quality certification trademark of the product or the geographical origin certification trademark);
• Map of the geographical area (if the registered trademark is a geographical origin certification trademark of a product, or a certification trademark containing a place name or other sign indicating the geographical origin of local specialties);
• Written of the People’s Committee of the province or centrally run city permitting the trademark registration (if the registered trademark is a a certification trademark containing a place name or other sign indicating the geographical origin of local specialties);
• Power of Attorney, if the application is filed through a representative;
• Documents proving the right to register, if the applicant enjoys that right of another person;
• Documents proving the right of priority, if there is a claim for priority right;
• Proof of payment of fees and charges.
