Issue postal license in Vietnam

A postal license is a legal document issued by the state management agency in charge of post to an enterprise eligible for provision of international postal services, inter-provincial post, intra-provincial postal and notification of postal activities. Only when a Postal License is granted can an enterprise legally operate a postal service business.

Types of postal licenses

• International Postal License;
• Intercity postal license;
• Intra-provincial postal license;
• Notification of postal operations.

Conditions for postal service enterprises in Vietnam

Financial conditions

• In providing international postal services, enterprises must have a minimum capital of VND 05 billion.
• Providing postal services within the province and inter-province, the enterprise must have a minimum capital of VND 02 billion;
• Notification of notification of postal activities must have a minimum capital of 02 billion VND for domestic postal notices, 05 billion VND for international postal notices.

General conditions

• Having a certificate of business registration of postal activities or an investment certificate in the postal sector;
• Have financial viability according to regulations;
  • In case of providing postal services within the province or inter-province, the enterprise must have a minimum capital of VND 02 billion;
  • In case of providing international postal services, enterprises must have a minimum capital of VND 05 billion.
• Having personnel suitable to the business plan according to the contents of the license application;
• Having a feasible business plan in accordance with regulations on freight rates and quality of postal services;
• Take measures to ensure information security and safety for people, post and postal networks.

Documents for issuance of postal licenses in Vietnam

• Application for a postal license (01 original and 02 copies).
• A copy of the certificate of registration of postal business or investment certificate of postal activities in Vietnam shall be certified by the enterprise itself and responsible for the accuracy of the copy (01 original and 02 copies).
• Charter of organization and operation of the enterprise if any (01 original).
• Business plan (01 original and 01 copy).
• Form of contract for supply and use of postal services in accordance with the provisions of postal law (01 original and 02 copies).
• Samples of logos, trademarks, distinctive symbols or elements of the enterprise’s identity system are shown on the post (if any) (01 original and 02 copies).
• A copy of the postal service tariff in accordance with the provisions of the law on post (01 original and 02 copies).
• The announced postal service quality standards shall be applied in accordance with the provisions of the law on post (01 original and 02 copies).
• Regulations on the limit of liability for compensation for damage in case of damage, the process of settling complaints of customers, the time limit for settling complaints in accordance with the provisions of the law on post (01 original and 02 copies).
• Agreement with other enterprises or foreign partners in Vietnamese, in case of cooperation in supplying one, some or all stages of the postal service applying for a license; (01 original and 02 copies).
• Consular legalized documents proving the legal status of foreign partners specified at Point k, Clause 2 of this Article (01 original and 02 copies)
• Business plan, including the following main contents: Information about the enterprise including name, address, phone number, fax number, email address (e-mail) of the transaction office, representative office, branch, website of the enterprise (if any) and other relevant information;
• The area where the service is expected to be provided;
• Systems and methods of service management and administration;
• The service delivery process includes acceptance, transportation and delivery;
• The method of service provision is organized by the enterprise itself or cooperates in providing services with another enterprise (in case of cooperation with another enterprise, the enterprise applying for a postal license must detail the scope of cooperation and coordination in ensuring safety, security, complaint settlement and compensation for damage to service users);
• Measures to ensure safety for people, post, postal networks and information security in postal activities;
• Analyze the feasibility and socio-economic benefits of the plan through indicators of output, revenue, costs, number of employees, taxes paid to the state budget, rate of return on investment in the next 03 years from the year of license application (01 original and 02 copies).

Note on postal license documents

• The enterprise applies for a postal license according to its actual ability to perform;
• Business plan, including the following main contents:
  • Information about the enterprise including name, address, phone number, fax number, email address (e-mail) of the transaction office, representative office, branch, website of the enterprise (if any) and other relevant information;
  • The area where the service is expected to be provided;
  • Systems and methods of service management and administration;
  • The service delivery process includes acceptance, transportation and delivery;
  • The method of service provision is organized by the enterprise itself or cooperates in providing services with another enterprise (in case of cooperation with another enterprise, the enterprise applying for a postal license must detail the scope of cooperation and coordination in ensuring safety, security, complaint settlement and compensation for damage to service users);
  • Measures to ensure safety for people, post, postal networks and information security in postal activities;
  • Analyze the feasibility and socio-economic benefits of the plan through indicators of output, revenue, costs, number of employees, taxes paid to the state budget, rate of return on investment in the next 03 years from the year of application for license.

• Written notification of postal activities (according to the form in Appendix II, Decree No. 47/2011/ND-CP dated 17/06/2011 of the Government of the Socialist Republic of Vietnam);
• A copy of the certificate of business registration of postal activities or the certificate of investment in postal activities in Vietnam certified by the enterprise itself and responsible for the accuracy of the copy;
• Form of contract for supply and use of postal services in accordance with the provisions of postal law;
• Logos, trademarks, distinctive symbols or elements of the enterprise’s identity system shown on the post (if any);
• The tariff list of postal services in accordance with the provisions of the law on postage;
• Published postal service quality standards shall be applied in accordance with the provisions of the law on postage;
• Stipulate the limit of liability for compensation for damage in case of damage, the process for settling customer complaints, the time limit for settling complaints in accordance with the provisions of the law on postage;

Dossier of application for confirmation of international postal operations notification

• Written notification of postal activities (according to the form in Appendix II, Decree No. 47/2011/ND-CP dated 17/06/2011 of the Government of the Socialist Republic of Vietnam);
• A copy of the written approval for franchise registration issued by a competent state agency shall be self-stamped and certified by the enterprise and responsible for the accuracy of the copy, in case of receiving a franchise from abroad into Vietnam;
• A copy of the expired postal license, a written confirmation of the issued notice of postal operation issued by the enterprise itself and responsible for the accuracy of the copy;
• Contracts with foreign partners;
• Consular legalized documents proving the legal status of the foreign partner;
• A copy of the certificate of registration of postal business or investment certificate of postal activities in Vietnam certified by the enterprise itself and responsible for the accuracy of the copy;
• Form of contract for supply and use of postal services in accordance with the provisions of postal law;
• Logos, trademarks, distinctive symbols or elements of the enterprise’s identity system shown on the post (if any);

Competence to grant postal licenses, written confirmation of postal operations notification in Vietnam

The Department of Information and Communications shall:

• Issuance of postal licenses in case of provision of mail services within the province;
• Issue a written confirmation of the notification of postal operations in the country.
• To act as branches and representative offices of postal service providers established under Vietnamese law;
• To act as a representative office of an enterprise providing foreign postal services.

The Ministry of Information and Communications shall:

• Issuing postal licenses in cases of provision of mail services within inter-provincial and international scopes;
• Issuing written confirmation of notification of international postal operations
• Working as an agent for foreign postal service providers;
• Receive franchises in the postal sector from abroad into Vietnam;
• Acting as a representative for foreign postal service providers;
• Acting as a representative office of an enterprise providing foreign postal services.

Postal license, written confirmation of postal operation notification in case of provision of postal services within inter-provincial and international scopes and valid for provision of postal services within the province of relevant provinces and centrally-run cities.

Procedure for applying for a postal license in Vietnam

Number of applications for Postal Licenses

• The enterprise submits 03 sets, of which 01 set is the original, 02 sets are copies certified by the enterprise itself and is responsible for the accuracy of the copy to the agency issuing the license for provision of postal services according to its competence.
• 01 set of records to keep at the enterprise.

Number of records for confirmation of postal operations notification

• The enterprise shall submit 01 set as the original to the agency issuing the license for provision of postal services according to its competence.
• 01 set of records to keep at the enterprise.

Application form

Enterprises can choose to apply through one of the following forms:

• Directly at state agencies;
• Through the postal service;
• Web portal of the licensing authority (if any);

Fees

Fees for issuance of written confirmation of postal operations notification

• Written confirmation of notification of intra-provincial postal activities: VND 1,250,000
• Written confirmation of notification of inter-provincial postal activities: VND 2,500,000
• Written confirmation of notification of international postal operations: VND 2,500,000
• In case of acting as an agent for an enterprise providing foreign postal services, receiving a franchise in the field of post from abroad into Vietnam and acting as a representative for an enterprise providing foreign postal services, the fee for issuance of a written license certifying the notification of postal operation from: VND 1,750,000 – VND 3,500,000.

• Intra-provincial postal service license: VND 10,750,000
• Inter-provincial postal service license: VND 21,500,000
• International Postal Service License:
  • International afternoon to VND 29,500,000
  • International departure: VND 34,500,000
  • Two-way international: VND 39,500,000.
