What is study abroad consulting?

Study abroad consulting, also known as study abroad consulting service business, is a conditional business line according to the provisions of the Investment Law 2020. Pursuant to Article 106 of Decree 46/2017/ND-CP, service business Study abroad consulting services include the following activities:

• Introducing and consulting information on educational policies of countries and territories; Consulting on choosing schools, courses, occupations, and qualifications suitable to the learner’s abilities and aspirations;
• Organize advertising, conferences, seminars, fairs, and exhibitions on studying abroad;
• Organizing student recruitment and admission to study abroad;
• Organize necessary skills training for Vietnamese citizens to study abroad;
• Organize sending Vietnamese citizens abroad to study, take parents or guardians to visit training places abroad according to the provisions of law;
• Other activities related to study abroad consulting service business.

According to Article 107 of Decree 46/2017/ND-CP, amended and supplemented by Decree 135/2018/ND-CP, the conditions for providing study abroad consulting services: The staff directly providing study abroad consulting must have a university degree or higher; Can use least one foreign language at level 4 or higher according to the 6-level Foreign Language Competency Framework for Vietnam and equivalent; Have a certificate of professional training in study abroad consulting according to regulations of the Ministry of Education and Training. When meeting the conditions, organizations providing study abroad consulting services need to carry out procedures to apply for a study abroad consulting certificate.

Procedures for granting study abroad consulting certificate in Hanoi

The procedure for granting a study abroad consulting certificate is specified in Clause 3, Article 108 of Decree 46/2017/ND-CP and is specifically guided in Decision 2108/QD-BGDDT. As follows:

Step 1: Apply for a study study abroad consulting certificate.

Organizations providing study abroad consulting services send directly or by post 01 set of documents to the Department of Education and Training of Hanoi city where study abroad consulting services are located.

Subjects carrying out administrative procedures include:

• Enterprises are established and operate according to the provisions of the Enterprise Law;
• Public service units with the function of providing study abroad consulting services;
• Foreign educational organizations operating legally in Vietnam.

Step 2: Processing documents.

Within 15 working days from the date of receiving a complete and valid application, the Director of the Hanoi Department of Education and Training will evaluate the application, verify the authenticity of the documents in the application, and issue a certificate for study abroad consulting services.

In case the prescribed conditions are not met, notify the study abroad consulting service organization in writing and clearly state the reason.

The result of the administrative procedure is the enterprise registration certificate for study abroad consulting services from the Director of the Hanoi Department of Education and Training.

Some notes for the center

• Study abroad consulting centers need to pay attention to the fact that the foreign language certificate of the direct consultant must correspond to the market they will advise on. For example, when studying abroad in countries that use English, a minimum foreign language certificate is required from B2 and above.
• Currently, there are no regulations on fees for granting study abroad consulting permits. Thus, when applying for a study abroad consulting permit, there is no need to pay a fee.
• During operation, organizations providing study abroad consulting services have the right to request the Department of Education and Training to adjust and supplement the enterprise registration certificate for study abroad consulting services.
• After being granted a Certificate, organizations providing study abroad consulting services need to carry out study abroad consulting activities no later than 45 working days from the date of issuance of the Certificate of registration of consulting services business. Study abroad consultation according to the provisions of Article 15 of Decree No. 86/2021/ND-CP.
