What is an export tax refund?
Export tax is an indirect tax levied on goods permitted to be exported and imported across Vietnam’s borders, including goods and services exported from the domestic market into non-tariff zones
Export tax refund means the refund of the collected tax amount of the enterprise by the competent tax-collecting agency because the actual tax collection is more than the payable tax amount or is not payable.
Cases eligible for export tax refund
According to the provisions of Articles 33, 34, 35, 36 of Decree 134/2016/ND-CP and amended and supplemented by Decree 18/2021/ND-CP dated 11/03/20221, it has clearly stated the cases of tax refund, including:
Conditions for export tax refund
Based on the production services of products and goods of business establishments, the conditions and regulations on VAT refund will be different. Basically, the conditions for enterprises to be refunded VAT are as follows:
Payment of VAT by the deduction method
Have a seal and business license/investment license or equivalent documents
Accounting vouchers and data are made and stored in accordance with accounting standards
Having a bank account with a tax identification number registered on the business registration certificate
Dossiers and procedures for VAT refund are in accordance with current regulations.
Export tax refund dossier
In each case, the VAT refund dossier is different. However, it should be noted that for dependent units of enterprises and agencies, organizations and units that are not part of the accounting unit to prepare financial statements, there must be a written authorization from the head office when carrying out tax refund procedures.
Details of the dossier include:
Procedures for refund of export tax in accordance with the provisions of law
After fully preparing the dossier of tariff rate refund corresponding to the case, the unit shall carry out export tax refund procedures as prescribed.
Pursuant to Article 12, Circular 06/2021/TT-BTC, the procedures are as follows:
Step 1: Submit tax refund dossiers
Enterprises shall submit tax refund dossiers at the Sub-department of Customs where customs declarations for exported goods are registered
Step 2: Check the dossier. Sub-department of Customs receives and checks tax refund dossiers
In case the dossier is complete and valid, the Sub-department of Customs shall seal the receipt and entry into the monitoring book
In case the dossier is incomplete, the Sub-department of Customs shall notify the enterprise to supplement the dossier within 03 working days from the date of receipt of the dossier.
Step 3: Decision on tax refund
Within 10 working days from the date of receipt of a complete and valid tax refund dossier, the Sub-department of Customs shall issue a decision on tax refund.
Step 4: Tax refund
The Sub-department of Customs shall refund the tax amount to the enterprise within 05 working days from the date of issuance of the tax refund decision.

Enterprises need to pay attention to the following things when carrying out export tax refund procedures
Prepare all documents as prescribed to get a quick tax refund
Submit tax refund dossiers within the prescribed time limit (the deadline for submission is 05 years from the date of incurring tax obligations)
Double-check the information on the tax refund dossier before submitting
Using e-customs software and e-invoice software to quickly declare and submit electronic documents saves time, cost and resources
