Conditions for setting up a website providing e-commerce services
Pursuant to Article 54 of Decree 52/2013/ND-CP (amended and supplemented by Clause 2, Article 10 and Article 11 of Decree 08/2018/ND-CP and Clause 19, Article 1 of Decree 85/2021/ND-CP), to set up a website providing e-commerce services, the following conditions must be met:
Be a trader or organization established following the law.
There is a plan to provide services that clearly states the following contents: Operational organization model, including service provision activities, service promotion and marketing activities both online and offline; logistics activities for goods, and the division of rights and responsibilities between traders and organizations providing e-commerce services and service users.
Registered to set up a website providing e-commerce services and has been confirmed by the Ministry of Industry and Trade as prescribed in Articles 55 and 58 of this Decree.
Procedures for registering a website providing e-commerce services
Registration dossier
01 Original copy of Application for registration of website providing e-commerce services (according to Form E-commerce-1 in the Appendix issued with Circular 47/2014/TT-BCT).
01 Copy from the original book or certified copy or copy presented with the original for comparison of the Decision on the establishment (for organizations), enterprise registration certificate, investment registration certificate, or investment license (for traders).
01 Project to provide e-commerce services as prescribed in Point a and Point c, Clause 3, Article 54, Decree No. 52/2013/ND-CP.
Regulations on management of the operation of websites providing e-commerce services as prescribed in Point d, Clause 2, Article 55 of Decree No. 52/2013/ND-CP.
01 Sample service contract or cooperation agreement between the trader or organization that owns the website providing e-commerce services and the trader, organization, or individual participating in buying and selling goods and providing services on that website.
General terms of transaction applicable to the purchase and sale of goods and provision of services on the website (if any).

Procedures
Submit online on the e-commerce management Portal at online.gov.vn, and submit in person or by post (for paper copies).
Step 1: Register an account on the system
Traders and organizations register for an account to log in at online.gov.vn by providing information according to the form.
Step 2: Provide an online account to register a website
Within 3 working days, traders and organizations will receive results from the Ministry of Industry and Trade via the registered email address regarding one of the following contents:
If the account registration information is complete, the trader or organization will be given a system login account and proceed to Step 3;
If account registration is rejected or additional information is required, the trader or organization must re-register or provide additional information as requested.
Step 3: Login to your assigned account and register
After being granted a system login account, traders and organizations log in, select the function of Registering a website providing e-commerce services, and declare information according to regulations.
Step 4: Wait for a response from the Ministry of Industry and Trade
Within 7 working days, traders and organizations will receive feedback from the Ministry of Industry and Trade via the registered email address regarding one of the following contents:
Confirm that the registration documents are complete, and valid and request the trader or organization to continue with Step 5;
Notification of invalid registration documents or requests for additional information. Then the trader or organization returns to Step 3 to re-declare or supplement information and documents as required.
Within 30 working days from the date of receipt of the notice requesting additional information as prescribed, if the trader or organization does not respond, the registration file on the system will be terminated and the trader or organization must re-register from the beginning.
Step 5: Send paper Documents to the Ministry of Industry and Trade
After receiving the notice confirming the complete and valid dossier, the trader or organization shall send to the Ministry of Industry and Trade (Department of E-commerce and Digital Economy) a complete registration dossier (paper copy) according to regulations.

Administrative results
Publicly announce on the E-commerce Management Portal the list of websites providing e-commerce services that have been registered according to regulations, including the following information: Name of e-commerce website and type of website according to notification or registration with the Ministry of Industry and Trade; Name and contact information of the trader, organization, individual owning the e-commerce website; Enterprise registration number of the trader, establishment decision number of the organization or personal tax code of the individual owning the e-commerce website.
The Ministry of Industry and Trade will send to the trader or organization via the registered email address a code to be attached to the website providing e-commerce services, displayed as a registration icon. When selecting this icon, the user will be directed to the corresponding registration information of the trader or organization at the E-commerce Management Information Portal.

Pursuant to Clause 4, Article 62 of Decree No. 98/2020/ND-CP on administrative sanctions for violations in commercial activities, production, trading of counterfeit and prohibited goods, and consumer protection
“A fine from VND 20,000,000 to VND 30,000,000 for one of the following violations:
a) Not registering the website providing e-commerce services or e-commerce service applications with the competent state management agency as prescribed;”
Thus, if a company operates without registering, it may be fined from 20,000,000 VND to 30,000,000 VND.
What are the violations of information on e-commerce websites?
Falsifying registration information or failing to comply with regulations on the form and manner of publishing registration information on e-commerce websites;
Using the logos of e-commerce website credit rating programs without being recognized by these programs;
Use links, logos, or other technology on e-commerce websites to confuse the relationship with other traders, organizations, or individuals;
Use the link to provide information that is contradictory or misleading to the information published in the area of the website where the link is located.
