Adjust and correct Investment Registration Certificate in Vietnam

• Circular 03/2021/TT-BKHDT stipulates the form of documents and reports related to investment activities in Vietnam, investment from Vietnam to abroad and investment promotion.

Cases of carrying out procedures for Correcting information on the Investment Registration Certificate in Vietnam

• In case the Investment Registration Certificate is stored as electronic data in the National Investment Information System with different contents than the Investment Registration Certificate, the Investment Registration Certificate whose contents are recorded strictly according to the contents in the investment registration dossier has legal validity. In this case, the investor will be able to correct the information on the Investment Registration Certificate in electronic data form and the Investment Registration Certificate in paper form so that the content matches the investment registration dossier with legal validity.
• In case the information on the Investment Registration Certificate is inaccurate compared to the information registered in the dossier of implementation of investment procedures. In this case, the investor will request the investment registration agency to correct the information on the Investment Registration Certificate so that it matches the dossier of implementation of investment procedures.

Dossier of correction and adjustment of the Investment Registration Certificate in Vietnam

The dossier of correction and adjustment of the Investment Registration Certificate includes the following documents:

• A written request for correction of information of the Investment Registration Certificate according to form A.I.18 specified in Appendix A of Circular 03/2021/TT-BKHDT (Fill in the prescribed information according to the form);
• A copy of the issued Investment Registration Certificate;
• In case the investor authorizes another person to submit the application and receive the result on his/her behalf, the person carrying out the replacement procedures must have one of the following documents:

• Service contract between a service-providing organization and an investor on supporting the implementation of procedures for Correcting information on investment certificates and referrals of that organization for individuals to submit dossiers and receive results;
• A written authorization for individuals to carry out procedures for Correcting information on investment certificates.

Procedures for correction and adjustment of the Investment Registration Certificate in Vietnam

Step 1: The investor prepares and submits the dossier at the Investment Registration Office where the investment project is located.

In case the investor authorizes another person to submit the application and receive the results of administrative procedures, the person who submits the application and receives the results of the settlement of investment registration procedures must present the citizen identity card or passport or other lawful personal identification documents and 1 of the following 2 types of documents:

• Service provision contract between the investor and the service provider submitting the application, receiving results and referrals of that organization to the individual who submits the application and receives the results; or
• A written authorization for individuals to submit applications and receive results in accordance with the provisions of law.

Step 2: Receive and check documents

The investment registration agency shall receive and examine the dossier, if the dossier is complete, receive the dossier and issue the Certificate of receipt of the dossier to the investor; If the composition of the dossier is incomplete, the receptionist/guide will explain for the investor to supplement and complete the dossier.

Step 3: Appraisal and approval of the application

Within 03 working days from the date of receipt of the dossier of request for correction of information on a valid Investment Registration Certificate, the Investment Registration Agency shall issue the Investment Certificate to the investor.

Step 4: Get the result

The Investor, based on the appointment date on the Application Receipt Form, shall receive the settlement results at the Investment Registration Office where the Investor submits the dossier requesting correction of information on the Investment Registration Certificate.
