How to set up printing service business company in Vietnam

Printing service is a popular service today. The State has many incentives and preferential policies for enterprises providing this service. However, the State also sets out a number of conditions for enterprises registering for printing business. Specifically in this article, Viet An Law would like to send to customers legal opinions on the order and procedures on how to set up printing service business company in Vietnam according to current legal regulations.

List of printed products

Printed products are products created by technology and equipment of the printing industry on different materials, including:

• Newspapers, magazines, and other press publications according to the provisions of the law on press;
• Forms and papers issued by state agencies;
• Anti-counterfeit stamps;
• Financial invoices, cards, papers with pre-printed face values or used to record face values (excluding money);
• Publications according to the provisions of the law on publishing;
• Packaging, goods labels;
• Documents and papers of organizations and individuals;
• Other printed products.

Conditions for operation of printing establishments

• Have suitable equipment to perform one or more stages of pre-press, printing, and post-press processing according to the needs and capabilities of the printing establishment and consistent with the content of the application for a printing operation license or the declaration of registration of printing establishment operation prescribed in Article 12 and Article 14 of Decree 60/2014/ND-CP;
• Have legal premises to perform pre-press, printing, and post-press processing;
• Have an owner that is an organization (state agency, political organization, socio-political organization, socio-political-professional organization, social-professional organization, public non-business unit, economic organization owned by Vietnamese citizens) or an individual who is a Vietnamese citizen;
• Have a head who is a Vietnamese citizen, legally residing in Vietnam, and has full civil act capacity.

Conditions for licensing printing operations

Before operating, printing establishments performing pre-press, printing, and post-press processing of products prescribed in Point a and Point c Clause 4 Article 2 of Decree 60/2014/ND-CP must have a dossier applying for a printing operation license sent to the state management agency on printing activities according to the following regulations:

• Printing establishments belonging to ministries, central agencies, and organizations, and printing establishments belonging to organizations and enterprises owned by the State send dossiers via the online public service system or postal, delivery services or submit dossiers directly at the Ministry of Information and Communications.
• Other printing establishments send dossiers via the online public service system or postal, delivery services or submit dossiers directly at the Provincial People’s Committee.
• For branch printing establishments performing pre-press, printing, and post-press processing located in a province or centrally run city other than the province or city where the head office is located, the Provincial People’s Committee where the branch is located shall grant the printing operation license.

Procedures for granting printing operation license

After completing the set up procedures to go into operation, the company needs to complete the following procedures:

Granting of printing operation license: applied to cases of printing the following products:

• Newspapers, magazines, and other press publications according to the provisions of the law on press;
• Anti-counterfeit stamps.

Registration of printing establishment operation: applied to the following cases:

• Newspapers, magazines, and other press publications according to the provisions of the law on press;
• Forms and papers issued by state agencies;
• Financial invoices, cards, papers with pre-printed face values or used to record face values (excluding money);
• Publications according to the provisions of the law on publishing;
• Packaging, goods labels;
• Documents and papers of organizations and individuals;
• Other printed products.

Dossier applying for printing operation license

• Application for a printing operation license according to the prescribed form;
• Certified copy or copy accompanied by the original for comparison of one of the types of business registration certificate, enterprise registration certificate, investment certificate, tax registration certificate, decision on establishment of printing establishment for public non-business printing establishments;
• Curriculum vitae of the head of the printing establishment according to the prescribed form;
• Power of attorney for Viet An Law.

Time limit: Within 15 days from the date of receiving a complete dossier according to regulations, the state management agency on printing activities must grant a license clearly stating the printing content suitable for the equipment of the printing establishment and update information into the national database on printing activities; in case of refusal to grant a license, there must be a written reply stating the reason.

Dossier for registration of printing establishment operation

The dossier for registration of printing establishment operation according to Article 14 of Decree 60/2014/ND-CP (amended by Decree 25/2018/ND-CP, Decree 72/2022/ND-CP) is as follows:

• Declaration of registration of printing establishment operation;
• Business Registration Certificate or establishment decision (business registration must have printing business lines);
• Documents proving the headquarters is leased or owned by the unit;
• Power of attorney for Viet An Law.

Time limit: Within 05 days from the date of having one of the confirmed changes in information, the printing establishment must send a Declaration of registration of change of information according to the prescribed form to the state management agency on printing activities to be re-granted the certificate of registration of printing activities.
