Increased Fire Safety Fines from July 1, 2025 in Vietnam

Currently, violations of fire prevention and fighting regulations are becoming increasingly common with many complex behaviors, causing numerous unfortunate consequences and damages. To enhance deterrence and prevent fire safety violations, the Government recently issued Decree 106/2025/ND-CP regulating administrative penalties for violations against fire prevention and firefighting, and rescue, with many new provisions on increased fine levels.     Overview of Decree 1062025ND-CP

    • Name: Decree 106/2025/ND-CP regulating administrative penalties for violations against fire prevention and firefighting, and rescue
    • Issuance Date: May 15, 2025
    • Effective Date: July 1, 2025
    • Superseding document: Abolishes Section 3 of Chapter II of Decree 144/2021/ND-CP dated December 31, 2021, of the Government regulating administrative penalties for against regulations on social safety, security, order; social evils; fire prevention and fighting; rescue; domestic violence prevention and control.
    • Scope of adjustment: Including administrative violations, penalties, fines, remedial measures imposed against administrative violations, persons having the power to issue violation records, impose penalties and specific fines.

    Increased Fire Safety Fines from July 1, 2025 in Vietnam

    Compared to Section 3 of Chapter II of Decree 144/2021/ND-CP on administrative penalties in the field of fire prevention and fighting, the new regulations in Decree 106/2025/ND-CP have significantly increased the fine levels for many fire prevention and fighting violations, specifically:

    INCREASED FIRE SAFETY FINES FROM JULY 1, 2025 IN VIETNAM

    Violations against regulations on dissemination of fire prevention, firefighting and rescue law and knowledge, provision of training in fire prevention, firefighting

    For the act of “Failing to buy compulsory fire and explosion insurance in respect of a group-I establishment posing a risk of conflagration”, it increased from 30.000.000 VND to 40.000.000 VND to 40.000.000 VND to 50.000.000 VND (Clause 4, Article 17, Decree 106/2025).

    Thus, Decree 106/2025/ND-CP has increased the fine levels for violations to align with new fire prevention and fighting efforts, with some acts reaching the maximum fine stipulated by the Law on Handling Administrative Violations. It focuses on significantly increasing penalties for serious acts that directly pose a risk of fire and explosion, or fail to ensure conditions for detecting and organizing fire fighting when fire and explosion occur, leading to widespread and large fires causing severe damage to people and property.

    • The increase in fine levels ensures legal validity, consistent with the nature and severity of violations in the Decree, but not yet reaching criminal liability.
    • At the same time, it aims to enhance deterrence, prevent violations, and, more importantly, raise awareness and responsibility of organizations, individuals, and heads of establishments in fire prevention and fighting, contributing to ensuring overall security and order, reducing the number of fire prevention and fighting violations, and thereby curbing the number of fires and damages caused by fires.

    Other notable new points in Decree 106/2025/ND-CP regulating administrative penalties for fire prevention and fighting

    In addition to increasing fire safety fines effective July 1, 2025, Decree 106/2025/ND-CP also has several other notable new points such as:

    Supplementing subjects and additional forms of penalties

    • Decree 106/2025/ND-CP supplements subjects to align with the Law on Handling Administrative Violations, the Law on Fire and Rescue, and practical realities, specifically: Dependent units of Cooperatives (Offices, Cooperative Branches); Organizations established under the Commercial Law; State authorities; Apartment building management boards that operate according to regulations on apartment building management boards and have juridical personality; Organizations assigned to oversee establishments in accordance with regulations of the Law on Fire and Rescue.
    • In addition, it supplements regulations on the additional penalty form of “Temporary suspension of operation” for acts that directly pose a risk of fire and explosion (Clause 6, Article 18; Clause 11, Article 20; Clause 8, Article 21; Clause 6, Article 23; Clause 6, Article 24; Clause 8, Article 25).

    Supplementing 7 new Articles to align with the Law on Fire and Rescue 2024

    • Article 19 regulates the circulation of fire prevention, fighting, and rescue vehicles and fire-resistant materials, structures to meet the requirements of fire prevention, fighting, and rescue work for fire prevention, fighting, and rescue vehicles, materials, and fire-resistant structures, which must be granted circulation permits before being put into operation or use on the market.
    • Article 20 regulates the equipping and installation of fire prevention, fighting, and rescue facilities.
    • Article 21 regulates the use of fire and rescue instruments.
    • Article 22 regulates the preservation/maintenance of fire and rescue instruments.
    • Article 23 regulates the smoke extraction.
    • Article 38 regulates the amendment and supplementation of some articles of the Government’s Decree 119/2017/ND-CP dated November 01, 2017 on penalties for administrative violations against regulations on standards, measurement and quality of goods.
    • Article 37 regulates the division of administrative penalty authority for competent individuals according to their assigned functions and duties, in line with the provisions of the Law on Fire and Rescue.

    Abolishing administrative penalty authority of some agencies

    The new Decree has abolished the administrative penalty authority of district-level People’s Committees and District Police Chiefs to align with the new organizational model.
