    Note when declaring increased social insurance for employees

    Clause 1, Article 42, Decision 595/QD-BHXH regulates the management of subjects paying social insurance as follows:

    Employees who have 2 or more labor contracts with many different units at the same time:

    • Pay social insurance and unemployment insurance according to the first labor contract;
    • Pay health insurance according to the labor contract with the highest salary;
    • Pay insurance for labor accidents and occupational diseases according to each contract.

    Penalties for late reporting procedures increase

    At point a, Clause 4, Article 41 of Decree 12/2022/ND-CP stipulates the penalties for administrative violations against regulations on labor, social insurance, and Vietnamese guest workers, specifically as follows:

    “4. A fine ranging from VND 2.000.000 to VND 4.000.000 per employee but not exceeding VND 75.000.000 shall be imposed upon an employer for the commission of one of the following violations:

    a) Failing to prepare and submit an application for participation in compulsory social insurance for employees within 30 days from the date of conclusion of the labor, employment, or recruitment contract; failing to prepare and submit an application for participation in unemployment insurance for employees within 30 days after the labor or employment contract becomes effective;”

    Thus, for each delayed declaration, the violating individual employer will be fined from 02 to 04 million VND but not exceeding 75 million VND. In case the employer is an organization that violates, it will be fined from 04 to 08 million VND/employee whose rights are violated but not exceeding 150 million VND (according to Clause 1, Article 6 of Decree 12/2022/ND-CP).
