Postal service is a service of accepting, transporting, and delivering postal items by various methods from the sender’s location to the recipient’s location via the postal network (except electronic methods). A postal service business license (Postal License) is granted to an enterprise that meets the conditions for postal service business and when granted a Postal License, the enterprise can legally operate a postal service business. A postal license is a legal document issued by the state postal management agency to a business or organization providing mail services with a receiving address and a single item weighing up to 2kg when meeting the conditions for international postal service business, inter-provincial postal service, intra-provincial postal service and notifying postal activities so that the business can legally operate postal service business.
Types of postal licenses include International postal license; Inter-provincial postal license; Intra-provincial postal license; and postal operation notification.
Postal license for the provision of postal services within the inter-provincial and international scope is also valid for the provision of postal services within the provincial scope of relevant provinces and centrally-run cities.
Postal license issuance procedures in Vietnam
Step 1: Determine business conditions
Enterprises wishing to conduct postal services should conduct their own research, compare, or use the services of Viet An Law to determine whether they are qualified to conduct business. Accordingly, enterprises conducting postal services are determined to be qualified when they meet both general and financial conditions.
General conditions
Have an enterprise registration certificate for postal activities or a certificate registration certificate in the postal sector;
Financially capable;
Have personnel suitable for the business plan according to the content of the request for a license;
Have a feasible business plan in accordance with regulations on postal rates and quality of postal services;
Take measures to ensure information security and safety for people, postal items, and the postal network.
Financial conditions
To provide international postal services, enterprises must have a minimum capital of 5 billion Vietnamese Dong;
To provide postal services within the province or inter-province, enterprises must have a minimum capital of 2 billion VND;
Notice of business postal activities must have a minimum capital of 02 billion Vietnamese Dong for domestic postal notices, 05 billion Vietnamese Dong for international postal notices.
Step 2: Prepare documents and files
Enterprises wishing to conduct postal services or Viet An Law, upon request of the Client, shall prepare the application for a postal license. Accordingly, the Client shall provide the following documents for Viet An Law to complete the application:
Information for drafting the Application for a postal license according to the form in Appendix I of Decree No. 25/2022/ND-CP.
A copy of the certificate of business registration for postal activities or the certificate of investment in postal activities in Vietnam, stamped and confirmed by the enterprise itself, and the enterprise is responsible for its accuracy.
Charter of organization and operation of the enterprise.
Business plan.
Sample contract for provision and use of postal services.
Logos, trademarks, special symbols or elements of the business’s identification system shown on postal items (if any).
Postal service price list.
Postal service quality standards announced and applied.
Regulations on the limit of liability for compensation for damages in case of damage, client complaint settlement process, and complaint settlement period.
Agreement with other enterprises and foreign partners in Vietnamese, in case of cooperation in providing one, some or all stages of the postal service for which a license is requested;
Consularized documents proving the legal status of foreign partners.
Business plan, including the following main contents:
Information about the enterprise includes name, address, telephone number, fax number, email address of the transaction office, representative office, branch, website of the enterprise (if any) and other related information;
Expected service provision area;
System and method of service management and operation;
The service delivery process includes acceptance, transportation and delivery;
The method of providing services is organized by the enterprise itself or in cooperation with other enterprises to provide services (in case of cooperation with other enterprises, the enterprise requesting the issuance of a postal license must present in detail the scope of cooperation, coordination in ensuring safety, security, handling complaints and compensating for damages to service users);
Measures to ensure safety for people, postal items, postal networks and information security in postal activities;
Analyze the feasibility and socio-economic benefits of the plan through indicators on output, revenue, costs, number of employees, taxes paid to the state budget, and return on investment in the next 3 years from the year of licensing application.

Application for postal license
The dossier to be prepared consists of 03 sets, of which 01 set is the original, 02 sets are copies stamped and certified by the enterprise itself and is responsible for the accuracy of the copy to the competent authority granting the postal service business license (the original will be kept at the enterprise). The enterprise providing postal services directly or authorizing Viet An Law to apply for a postal license in the following ways:

Department of Information and Communications of the province or city where the enterprise applies for a license to operate: Issues postal licenses for cases of providing services within the province;
Postal Department under the Ministry of Information and Communications: Issues postal licenses for cases of providing services within inter-provincial and international scope. Apply online through the National Online Public Service Portal at: http://dichvucong.gov.vn or the Online Public Service Portal of the province or centrally-run city.

Step 4: Competent authority receives, processes documents and results
Within 03 working days from the date of receipt of the dossier, the Department/Ministry of Information and Communications shall refuse to grant a postal license in cases where it is not within its authority and state the reason. In cases where it is within its authority, the Department/Ministry of Information and Communications shall process the dossier and return the result:
In case of valid documents: Within 20 days of receiving the documents, the Department/Ministry of Information and Communications shall issue a postal license in case the documents are complete and in accordance with regulations.
In case of invalid documents:
In case the dossier does not meet the regulations, the Department/Ministry of Information and Communications shall notify the enterprise or organization to make amendments and supplements.
Within 15 working days from the date of notification, enterprises and organizations are responsible for amending and supplementing the dossier as required.
In case the enterprise or organization does not amend or supplement the dossier as required or amends or supplements but does not meet the requirements, the Department/Ministry of Information and Communications shall issue a notice of refusal to grant a postal license and state the reason.
Note:
Notifications of the Department/Ministry of Information and Communications are made in writing and via the online public service system.
Enterprises and organizations applying for a postal license that submit their application via the online public service system to the competent state postal agency shall be responsible for the legality, accuracy and honesty of the application.
The results of the postal license issuance procedures and the confirmation document of the postal operation notification are returned directly, online or via the public postal service.
