Classification version 2023 of patent registration in Vietnam

On December 27, 2022, the NOIP issued Notice No. 11220/TB-SHTT dated December 20, 2022 on the uniform application of the International Classification of Inventions (under the Strasbourg Agreement) version 2023.01.

Application duration of patent classification version 2023 in Vietnam under the Strasbourg Agreement

Accordingly, from January 1, 2023, the classification of technical solutions to be protected for patent applications is applied according to the Classification of patent registrations version 2023 (under the Strasbourg Agreement) version 2023.01. The Vietnamese version of the International Classification of Inventions version 2023.01 (translated from the English version published by the World Intellectual Property Organization) was published by the NOIP in the Industrial Property Gazette No. 417 published by the NOIP on December 26, 2022, on the web portal of the NOIP (www.ipvietnam.gov.vn).

Specific sections of the classification version 2023 of patent registration in Vietnam, under the Strasbourg Agreement version 2023.01

Specific sections of the International Classification of Inventions under the Strasbourg Agreement, version 2023.01 still include the following major sections:

  • Part A: The needs of human life;
  • Part B: Technology and transportation processes (B01-B43) and from (B44 to B99);
  • Part C: Chemistry, Metallurgy (C01-C07) and (C08-C99);
  • Part D: Textile, Paper;
  • Part E: Construction, mining;
  • Part F: Mechanics, lighting, heating, weapons, explosive engineering;
  • Part G: Physics;
  • Part H: Electricity.

Basis of application in the patent registration process in Vietnam

According to the provisions stated at point 23.5 of the Circular No. 01/2007/TT-BKHCN dated February 14, 2007 guiding the implementation of the Government’s Decree No. 103/2006/ND-CP of September 22, 2006 detailing and guiding the implementation of a number of articles of the Intellectual Property Law on industrial property, amended and supplemented according to Circular No. 16/2016/TT-BKHCN. In the section “International classification of inventions” in the patent registration declaration, the applicant needs to state the index of classification of technical solutions to be protected according to the new International Classification of Inventions (under the Strasbourg Agreement) published by the National Office of Intellectual Property in the Industrial Property Official Gazette (full classification, including section, class, subclass, group (main group or subgroup)).If the applicant fails to classify or classifies incorrectly, the NOIP will classify and the applicant must pay the prescribed classification fee.
