Trademark protection fees in 2024

Brand protection is a solid shield for businesses, helping to affirm their position and prevent unfair competitive behavior. However, many businesses are still apprehensive about the cost of protection. This article will help customers better understand the fees, payables and factors affecting the total state fee of trademark protection in Vietnam in the year 2024, thereby making effective investment decisions.

    Legal Basis

    • Circular No. 263/2016/TT-BTC stipulates the collection rate, regime of collection, remittance, management and use of industrial property fees and charges.
    • Circular No. 43/2024/TT-BTC stipulates the collection of a number of fees and charges in order to continue to remove difficulties and support production and business activities.

    In general, the cost of trademark protection in 2024 has not changed, the types of trademark protection fees when applying Circular No. 263/2016/TT-BTC take effect from 2017. However, in order to support and create more favorable conditions for production and business activities. Through the adjustment and reduction of the collection of a number of fees and charges, this Circular aims to reduce the cost burden on enterprises, especially in the context of difficulties caused by natural disasters, storms and floods, epidemics and other macroeconomic factors

    • Fees for applying, granting diplomas, and maintaining validity: These fees are all reduced by 50% compared to the usual fees, showing the state’s interest in supporting businesses to protect their brands right from registration to maintenance.
    • Search and examination fees: Although they are not exempted or reduced during the application period of the Circular, this fee is still kept at a reasonable level, in order to ensure the quality of examination and protect the interests of related parties.
    • Trademark search fee for more than 6 goods/services: This fee also increases compared to the situation of not applying exemption or reduction during the effective period of the Circular. However, this increase is still at an acceptable level.

    In general, Circular 43/2024/TT-BTC has brought great good news to the business community when sharply reducing the trademark protection fee. Thanks to this policy, businesses, especially small and medium-sized enterprises, will significantly reduce the financial burden when registering for protection of their products and services. The fee reduction not only creates favorable conditions for businesses but also contributes to promoting the spirit of creativity and protecting intellectual property rights. With lower brand protection fees, more businesses will be more motivated to apply for protection, thereby contributing to building and developing a creative and competitive economy.
