Computer Services Trademarks Registration in Vietnam

Currently, the computer is very useful, it helps people in studying and working a lot. In the using process, many problems cannot be solved by people without specialized knowledge in the computer field, so computer services businesses have grown. Business entities, if they want to perform trademarks registration in Vietnam for the services they provide, can refer to the following trademark registration procedures:

Class trademark registration classification:

         Goods/services intended to register shall be classified according to the Nice Classification. Computer services can be classification in the following:

Class 37: Installation, maintenance, or repairment of computer hardware;

Class 42: Computer data recovery, Computer programming, Computer software installation services, Computer software design, Virus removal for computers,…

Documents need to be prepared:

  • 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
  • A list of goods/services intended to register;
  • A trademark registration declaration (if customers authorize Viet An Law to submit, this declaration will be signed by the representative of Viet An Law);
  • A power of attorney Viet An Law to submit;
  • Receipts of fee payments.

Notices: Trademark samples can be registered in color or black-and-white. However, when registering in black-and-white, the owner can change color while still be protected.

After receiving the application, the Intellectual Property Office will process it within 13 – 18 months. In this process, the owner needs to monitor the process and answer the questions from the third party (if there is).

A protection title is valid from the date of granting and lasts 10 years from the date of submission. Therefore, after being granted a protection title, the remaining term of protection of the trademark is approximately 9 years. The protection title can be renewed every 10 years an unlimited number of times. However, the extension must be following the statutory order and procedures and the owner shall pay the full fee. An application for extension includes these documents:

  • A request to renew the valid protection title declaration;
  • The original protection title;
  • A power of attorney (in case submitting through the representative);
  • Receipts of fee payments.

Besides, the owner can transfer the trademark owner for others to use. However, a transfer contract needs to register at a competent state agency to take effect.
