Beauty Services Trademarks Registration in Vietnam

 The aesthetic standards of people in different periods are not the same. Accordingly, each period has its way of beauty. Currently, a person can completely change, become more beautiful due to modern beauty services. More and more beauty services are being opened up to meet the needs of a large number of people, mostly women. To increase competitiveness in the market, beauty services businesses can apply for trademark protection.

 A brand (also known as a trademark) is a special type of business property. A brand contributes to increasing the value of that business and gives a lot of benefits from the use or transfer of the right to use the brand. Besides, a trademark helps to attract more customers, creating favorable conditions in the business.

 Before submitting a trademark registration application, the applicant needs to classify the goods/services according to the Nice Classification. Accordingly, beauty services include Beauty salon; Hair salon; Makeup service,… under class 44.

A trademark registration application includes the following documents:

• 01 trademark sample with dimensions bigger than 3 x 3 cm and smaller than 8 x 8 cm;
• A list of goods/services intended to register;
• A trademark registration declaration (if customers authorize Viet An Law to apply, this declaration will be signed by the representative of Viet An Law);
• A power of attorney Viet An Law to submit;
• Receipts of fee payments.

For collective trademarks/certification trademarks, these documents are required:

• Regulations on using collective trademarks/certification trademarks;
• A description of the characteristic (or specific) nature and quality of the product bearing the trademark (if the trademark is registered as a collective trademark for a specific product or a certification trademark quantity of the product or trademark certifying of geographical origin);
• A geographical map (if the registered trademark is a trademark certifying the geographical origin of the product, or a collective trademark, a certification trademark contains a place name or other trademarks indicating the geographical origin of the local property product);
• A document of the People’s Committee of Provinces/Centrally Cities permitting the registration of the trademark (if the registered trademark is a trademark certifying the geographical origin of the product, or a collective trademark, a certification trademark contains a place name or other trademarks indicating the geographical origin of the local property product).

The Intellectual Property office considers the application about 13 – 18 months from the date of receiving the valid application.

After being granted the protection title, the owner has full right to use the trademark according to law and the scope of corresponding protection. Besides, the owner can transfer the right to use to another. However, the right to use a collective trademark is not allowed to transfer to individuals/organizations who are not the owner of that collective trademark.

The protection title is valid for 10 years from the date of submission. The validity can be renewed many consecutive times provided that the owner pays the renewal fee.
