Temporary residence card for directors in Vietnam

Nowadays, in the era of economic integration among countries, foreign-invested companies in Vietnam are quite established and the number of companies is constantly increasing. That is why affirming Vietnam’s potential in the investment field has helped economic growth as well as society. To facilitate the stay of foreigners working in Vietnam, the State always has certain policies, including the provision of temporary residence cards for directors of foreign-invested companies.

    The legal basis for the grant of a temporary residence card for the director of the foreign-invested company

    • Law on entry, exit, transit, and residence of foreigners in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014);
    • Circular No. 04/2015/TT-BCA, dated January 5, 2015, of the Ministry of Public Security, providing for documents related to entry, exit, and residence of foreigners in Vietnam;
    • Circular No. 219/2016/TT-BTC dated 10/11/2016 of the Ministry of Finance regulating the regime of collection, payment, management, and use of fees in the fields of exit, entry, transit, and residing in Vietnam.

    Conditions for the grant of temporary residence cards to directors of foreign-invested companies

    • Foreigner’s passport duration must be more than 1 year;
    • Visas being used in Vietnam must have DN symbol
    • Documents proving that the foreigner is the director of a foreign-invested company.

    Application file for temporary residence card of a foreign-invested company

    • Written request of agencies, organizations, or individuals that carry out the procedures for inviting or guaranteeing;
    • Application form for temporary residence card with photo;
    • Foreigner’s passport applying for temporary residence card;
    • Notarized copy of Business Registration Certificate, Investment License of the company;
    • Work permit with the title of manager or confirmed not subject to work permit issuance;
    • Seal registration certificate or a written notice on the posting of information about the enterprise’s seal sample on the national business registration portal;
    • Registration of seal sample and signature for the first time at the XNC Agency (Form NA16);
    • Official letter and application for temporary residence card for foreigners (Form NA6);
    • Application form for temporary residence card for foreigners (Form NA8);
    • Letter of recommendation for Vietnamese staff to apply for a temporary residence card at the Immigration Office;
    • Passport and original visa (passport valid for at least 13 months and visa to enter Vietnam for the right purpose);
    • A certificate of the foreigner’s temporary residence registration or temporary residence registration certified by the police of the ward or commune where the foreigner is temporarily residing in Vietnam;
    • 02 individual photos sized 2cm x 3cm

    Procedures for applying for a temporary residence cards to directors of foreign-invested companies

    Step 1: Prepare documents under the law

    Step 2: Submit the application

    Location:

    • 44-46 Tran Phu, Ba Dinh, Hanoi.
    • 254 Nguyen Trai, District 1, Ho Chi Minh City.
    • 7 Tran Quy Cap, Da Nang City
    • Division of immigration administration of police authority of the province or central-affiliated city.

    The above mentioned Immigration Administration receives the dossier to check the legality and content of the dossier

    • If complete, valid, then receive the application, print and give a receipt, make an appointment to return the results.
    • If the dossier is not valid, the application-receiving officer instructs the applicant to supplement the application for completeness.

    Application time: From Monday to Saturday morning (excluding New Year, holidays, and Sunday).

    Step 3: Obtain permits

    Within 05 working days, investors come to receive the results of giving receipts, identity cards, or passports to the officials who return the results of checking and comparison. If there are results of temporary residence cards, they request Pay the fee then sign to receive and give the temporary residence card to the person who comes to receive the results (even if not processed).

    Time to return results: From Monday to Friday (excluding New Year’s Day, public holiday, and Saturday, Sunday).

    Duration of temporary residence card for directors of foreign-invested companies in Vietnam

    • The temporary residence card with the symbol LD is valid for no more than 2 years.
