Reissue work permits to foreigners in Vietnam

Foreign workers working in Vietnam must have a work permit – a legal document that ensures conditions for foreign workers to legally work in Vietnam. However, in many cases the work permit may be lost, damaged or simply because the employee wants to change his or her information. For these situations, Viet An Law would like to generally appreciate the procedures for re-issuance of work permits as follows.

Order to reissue of work permit in Vietnam

Step 1: The employee informs the employer about having to reissue the work permit

After the employee discovers that the work permit is lost or damaged or the information on the work permit has been changed such as: full name, date of birth, nationality, passport number, passport issuance date, working location, workplace, the employee with foreign nationality is responsible for reporting to the employer.

Step 2: The employer submits an application for re-issuance of a work permit

The employer receives a report from an employee of foreign nationality notifying that the work permit is lost or damaged or the information on the work permit has been changed such as: full name, date of birth, nationality, passport number, passport issuance date,  At work location or workplace, the employer must submit an application to the provincial labor management agency where such work permit was issued to reissue the work permit to the foreign worker.

Step 3: State agency reissue work permits

Within 03 working days after receiving a complete application for re-issuance of a work permit, the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs shall reissue the work permit. In case of refusal to reissue a work permit, a written reply clearly stating the reason shall be given.

Application to reissue of work permit in Vietnam

• A written request for re-issuance of a work permit by the employer according to Form No. 11/PLI Appendix I issued together with Decree 152/2020/ND-CP
• 02 color photos (size 4 cm x 6 cm, white background, straight face, bare head, no stained glasses), photos taken not older than 06 months from the date of submission.
• A valid work permit has been issued:
• In case the work permit is lost, it must be certified by the commune-level public security agency where the foreigner resides or the competent authority of the foreign country as prescribed by law;
• In case of changing the contents stated on the work permit, there must be supporting documents.
• Written approval of the need to employ foreign workers, except for cases where the need to employ foreign workers is not required.

What is the duration of the work permit reissued?

The duration of the reissued work permit is equal to the duration of the issued work permit minus the time the foreign worker has worked up to the time of applying for re-issuance of the work permit.
